eﬀectiveformofpunishment.Ontheotherhand,theuseofthephrase(alterna-

tive’maybecomesomesortofapromiseofdecongestioninpenitentiaryunits,

apromisethatinpresentconditionscannotbekept.

Wecanexpectthatpenaltieslikeheavyﬁne,compulsorysociallabour,resi-

dentialsupervisionormandatorytreatmentwouldbeapplied,inthebeginning

atleast,exclusivelytopersonseitherconditionallyreleasedfromapartofimpris-

onmentsentenceorthosewithsuspendedpunishment.

Inordertobridgethegapbetweenunconditionalimprisonmentandtheac-

tionsundertakeninthecaseofprobation,asystemofintermediatepenalties,

appropriateforourpresentcircumstances,shouldbedesignedandimplemented.

Whyintermediatepenaltiescannotbecalledintermediatesanctions?Where-

asinsocialreceptionpunishmentistantamounttoimprisonment,intermediate

sanctionswouldbeassociatedwithaslightlymorelenientformofactiontaken

againstanoﬀenderwhoviolatedlaw.Intermediatepenaltiescannotthusbecome

somethingextraordinaryandlesssevere.heyneedtoconstituteaseparateele-

mentofthesystemofmeasuresofpenalrepressionwithintheirownright.

hepunishmentshouldbeinevitable.heoﬀendercannotescapesuﬀering,

constraintandlibertyrestrictions.hereductionoffreedomrightsmay,how-

ever,takeplacenotonlyintheconditionsofprisonisolationbutalsowithinthe

contextofsomesocialinteractionofadiﬀerentkind.

Nevertheless,itneedstobestressedthatanyoﬀenceagainstlawshouldresult

intoughsanctions,forexampleimprisonmentorintermediatepenalties.None

ofthefollowingiseligiblehere:

–capitalpunishment,whichisnotaimedattheoﬀender’sreformationand

fulﬁlsonlytheeliminatingfunction;

–stigmatizingpenalty,whichcausesdisgrace;

–corporalpunishment(e.g.ﬂogging),whichbringsdisgracenotsomuchto

theoﬀenderbutrathertothesocietyadvocatingit.

ingthefullsentence,conditionalstayofthecarryingoutofasentenceandcondi-

tionaldiscontinuanceoflegalproceedings)inoperationinPolandatthemoment

doesnotallowtosuccessfullyeliminatethenegativeconsequencesofimprison-

mentandatthesametimepreventfromrecidivism.

Forsomeoﬀenderstheveryfactofformalaccusationorarecordincourtﬁles

maybeasuﬃcientpenalty.Forothersitistheproceduresinvolvedinthecourt

trialandthefeespaidtolawyers.heuncertaintyandfearconnectedwiththe

actofaccusationandsentencingcanbesoharshthatfrequentlythesentenceof

punishment(withouttheabilityofprobation)becomestoohighaburdenforthe

oﬀender.

Howtodiﬀerentiatebetweenaproperlyformedandadjudicatedintermediate

sentenceandstandardprobation?Insomecasesitcanbeverydiﬃcult.However,
