betreatedthesame.Itisafaultyunderstandingoftheideaofappropriatepun-

ishment.Modernsystemofpenalmeasuresallowstheadjudicationofvaried

penaltiesinsimilarcircumstances.Asaresultsomeconvictsaresenttoclosed

penitentiaryinstitutionswhileothersaresubjecttorepressionsatliberty.

Whatshouldbedoneinorderthatintermediatepenaltiescanfulﬁlltheir

functions?

Firstly,theyneedtobeappliedonalargescale,whichwouldallowtoelimi-

natetheoverpopulationofprisonsandleadtogradualdecreaseinimportance

ofboththeinstitutionofconditionalreleasefromservingthefullsentenceand

suspendedsentencesofimprisonment.

Secondly,theyneedtobeﬁrmlyexecuted.Dismissalsandadjournments

wouldbeappliedonlyinexceptionalcases.

hirdly,ifthepersonsentencedtointermediatepenaltyfailstofulﬁllitsre-

quirements,theoriginalrepressionsshouldbetightenedrelativetotheoﬀence.

Fourthly,ﬁne,appliedasintermediatepenalty,shouldbeconsideredaseither

aseparatepenaltyorapartofaspeciﬁedcollectionofsanctions.Onlyafterthe

settlementofthismattershouldweestablishthesumofmoneytobepaidas

wellasthepossibilityofpayingitininstalments.heamountofmoneytobe

paidshouldbeadjustedtotheﬁnancialcapabilityoftheoﬀender.hedatesof

paymentsshouldbetightlyobserved.However,itisthewayofestimatingand

theprocedureofexecutionofpaymentsthatrequirethegreatestinnovations.At

presentﬁnesaretoolow,theyarenotcommensuratewiththeﬁnancialcapabili-

tiesofoﬀenders,andtheyareexecutedwithdiﬃculties.

Fifthly,compulsorysociallabourmightbeappliedaseitherasinglerepres-

sionorapartofacollectionofpenalties.Itmightbeadjudicatedwithregardto

oﬀendersofbothhighandlowﬁnancialstatus.Itsadaptationcanbringpositive

resultsonconditionthatitsexecutioniscarefullysupervised.

Sixthly,inordertoachieveasigniﬁcantlygreatercontroloverthebehaviour

ofthepersonssentencedwithinsocietyandtoenabletheirreturntonormallife,

freefrompathologicalphenomena,weshouldapplyintensiveprobation,which

canforinstancecombinehousearrestwithcompulsorytreatmentandelectronic

monitoring(thecostofwhichwouldinpartorinwholebecoveredbythecriminal).

Seventhly,priortotheintroductionofanewsystemofintermediatepenalties

courtsshouldbesubjectedtotheinﬂuenceofspeciﬁcinterpretativedirectivesof

modernjurisdictionpolicy:

a)thereisawholearrayofcasesinwhichthesentencesofimprisonmentas

wellasintermediatepenaltiesmightbeappliedtothesameextent(simi-

larlytheprobationmeasuresandintermediatepenalties);

b)acomprehensivecollectionofinformationabouttheoﬀendershouldbe

compiled(hispersonalqualities,ﬁnancialstatus,familyrelations,etc.)in

ordertobecapableofdecidingonanappropriateﬁne,compulsorysocial

labour,treatmentprogramme,residentialsupervisionormonitoringwith
