betreatedthesame.Itisafaultyunderstandingoftheideaofappropriatepun-
ishment.Modernsystemofpenalmeasuresallowstheadjudicationofvaried
penaltiesinsimilarcircumstances.Asaresultsomeconvictsaresenttoclosed
penitentiaryinstitutionswhileothersaresubjecttorepressionsatliberty.
Whatshouldbedoneinorderthatintermediatepenaltiescanfulfilltheir
functions?
Firstly,theyneedtobeappliedonalargescale,whichwouldallowtoelimi-
natetheoverpopulationofprisonsandleadtogradualdecreaseinimportance
ofboththeinstitutionofconditionalreleasefromservingthefullsentenceand
suspendedsentencesofimprisonment.
Secondly,theyneedtobefirmlyexecuted.Dismissalsandadjournments
wouldbeappliedonlyinexceptionalcases.
hirdly,ifthepersonsentencedtointermediatepenaltyfailstofulfillitsre-
quirements,theoriginalrepressionsshouldbetightenedrelativetotheoffence.
Fourthly,fine,appliedasintermediatepenalty,shouldbeconsideredaseither
aseparatepenaltyorapartofaspecifiedcollectionofsanctions.Onlyafterthe
settlementofthismattershouldweestablishthesumofmoneytobepaidas
wellasthepossibilityofpayingitininstalments.heamountofmoneytobe
paidshouldbeadjustedtothefinancialcapabilityoftheoffender.hedatesof
paymentsshouldbetightlyobserved.However,itisthewayofestimatingand
theprocedureofexecutionofpaymentsthatrequirethegreatestinnovations.At
presentfinesaretoolow,theyarenotcommensuratewiththefinancialcapabili-
tiesofoffenders,andtheyareexecutedwithdifficulties.
Fifthly,compulsorysociallabourmightbeappliedaseitherasinglerepres-
sionorapartofacollectionofpenalties.Itmightbeadjudicatedwithregardto
offendersofbothhighandlowfinancialstatus.Itsadaptationcanbringpositive
resultsonconditionthatitsexecutioniscarefullysupervised.
Sixthly,inordertoachieveasignificantlygreatercontroloverthebehaviour
ofthepersonssentencedwithinsocietyandtoenabletheirreturntonormallife,
freefrompathologicalphenomena,weshouldapplyintensiveprobation,which
canforinstancecombinehousearrestwithcompulsorytreatmentandelectronic
monitoring(thecostofwhichwouldinpartorinwholebecoveredbythecriminal).
Seventhly,priortotheintroductionofanewsystemofintermediatepenalties
courtsshouldbesubjectedtotheinfluenceofspecificinterpretativedirectivesof
modernjurisdictionpolicy:
a)thereisawholearrayofcasesinwhichthesentencesofimprisonmentas
wellasintermediatepenaltiesmightbeappliedtothesameextent(simi-
larlytheprobationmeasuresandintermediatepenalties);
b)acomprehensivecollectionofinformationabouttheoffendershouldbe
compiled(hispersonalqualities,financialstatus,familyrelations,etc.)in
ordertobecapableofdecidingonanappropriatefine,compulsorysocial
labour,treatmentprogramme,residentialsupervisionormonitoringwith
