it.Onthecontrary,theymightproveusefultoit.Manyoﬀendersbelongingin

thisgroupcouldhavebeensparedimprisonmentifaproperlyadvancedsystem

ofpenaltymeasuresexisted.

Ontheotherhandmanyconvictswhohavehadtheirsentencescondition-

allysuspendedorhavebeengrantedconditionalreleasefromservingthefull

sentenceshould,whileonprobation,besubjectedtosupervisionstricterthanat

present.Forsomeofthem,insteadofsuspendingtheexecutionofthepunish-

mentofisolation,anobligatoryincreaseoftheﬁnewouldprovemoreﬁtting.

Otherscouldforinstancebeassignedtodiﬀerenttasksconnectedwithenviron-

mentprotection.heprobationmeasuresprovidedforinthepresentpenalcode

failtogivetheoﬀenderasuﬃcientopportunityofreturningtonormallifedueto

theirmildness.heviolationoftheconditionsofprobationisfrequentsinceits

executionisnotproperlysupervised.

Tosumitup,thePolishpenalcodehasnotbeensuﬃcientlypolarized.he

kindofsentencepassedoftentimesdoesnotcorrespondwiththegravityofcom-

mittedcrimeaswellasthethreattheoﬀenderposestothesociety.Betweenthe

punishmentofimprisonmentandprobationmeasuresthereexistsagap,which

cannotbebridgedonlythroughthepenaltyofrestrictedliberty.Acomprehensive

systemofpenalrepressionshouldbesupplementedwithacollectionofinterme-

diatepenalties.hiswouldhelpeliminatethepunishmentofimprisonmentand

probationmeasureswithregardtocertaincategoriesofoﬀenders.

Intheperiodofthetransformationofthepoliticalsystemweareparticularly

subjecttotheepidemicofcrimesbyso-called(white-collars’aswellasorganized

crime.Inordertopreventtheseunwelcomesocialphenomenafromhappening,

weintroducestricterlawsconcerningpenalliability,mostlybyincreasingthe

threatofimprisonmentwithregardtospeciﬁctypesofoﬀences.However,we

failtomakeproperuseofthepossibilitiesoﬀeredbyﬁnancialpenaltyforexam-

ple.Somecountries,includingScandinaviancountries,treatﬁneasaprincipal

penaltyinthesystemofpenalmeasures.heamounttobepaidisestablishedon

thebasisoftheconvict’sﬁnancialstatusandhisorherearnings.Itisarepres-

sionthatsuccessfullypreventspotentialcriminalsfromviolatingthelaw.his

isduetothefactthatthispenaltypainfullydiminishestheeconomicposition

oftheoﬀender.InPolanditisusuallyonlyasupplementtothepunishmentof

imprisonment.

AtpresentinPolandﬁneiscalculatedonthebasisofthenumberofdailyrates

andthesumofmoneyattributedtoeachrate.heminimumrateequals10zlotys

whilethemaximumhasbeensetat2000zlotys;theminimumnumberofratesis
