Inordertoimprovetheeﬃciencyofthemeasuresofinﬂuence

withregardtotheperpetratorsofincriminatedactstheyshouldbeproperlydif-

ferentiated.helimitationofthesemeasurestothepunishmentofimprisonment

orprobationmeasuresisinsuﬃcient.Atthemomentthereisanemptygapbe-

tweenprisonisolationandstandardprobation.hisgapcanbebridgedthrough

punitivemeasuresofadiﬀerentkind.

heexcessesinneithertheliberalizationnorthepunitionofpenalmeasures

areuncalledfor.hereforeweneedtogrowmoreconﬁdentaboutthemodiﬁca-

tionofprobationactivitiesmilderthanthepenaltyofdeprivationofliberty.At

presenttoomanyconvictsareheldinpenalinstitutionsandtoofewaresubjectto

othermeasuresofcompulsorysocialcontrol.Ontheonehandwetendtobetoo

lenientinpunishing,ontheother–toosevere.Wearetoolenientwithregardto

personswhoshouldbeunderstrictersocialsupervisionandwhoarenowsubject

toprobationmeasures,whereaswearetooseverewithregardtothoseconvicts

whoposenoseriousthreattopublicsafety.

Whydoespunishingpolicyfailtoyieldsatisfyingresults?Onereasoncould

besocialattitudetothemeasuresofpenalrepressionandtheoriginofthecrimi-

nallaw.Otherreasonscouldbetheunstabledevelopmentofpenitentiarystruc-

turesorthemultiplicityofinstitutionsshapingthelegalandtheactualsituation

ofpersonspenalized.Inordertostimulateandimprovethepunishingpolicy,

intermediatepenalties,situatedinbetweenimprisonmentandstandardproba-

tionmeasures,shouldbeintroduced.
