Thefirsttwoscenarios,near-optimalthoughtheymight
be,wouldbeverydifficulttoimplementeveninadistant
future,giventheemotionsonbothsidestotheconflictwhich
willbepushingupthepoliticalpriceofthebilateral
scenariosinRussiaandinUkraine.Fromthisstandpoint,
lowercostswouldbebornewiththethirdscenario,providing
fortheestablishmentofatemporaryRussian-Ukrainian
condominiumunderaninternationaltrusteeship.
Asimilarcondominiumdidexistbetween1919and1939.

powerwasexercisedbytheLeagueofNationsHigh
Commissioner11.Today,theUnitedNationsTrusteeship
Councilcouldproveuseful.Establishedtoensure
thepeacefulcourseofdecolonisation,thatbodyisstill
inexistenceeventhoughmosttrustterritoriesgained
independenceinthe1960s,andthelast(Palau)in1994
anditcancomeinhandyasapeacefulsolutionfor
theCrimeaproblemissought.Thepossibilityofa
contentiousterritorycomingunderUNtrusteeship
onavoluntarybasisisprovidedforinChapterXIII
oftheUnitedNationsCharter.Thetermsoftrusteeshipfor
aparticularterritoryarespecifiedinaninternational
agreement,whereintheadministeringauthorityisindicated.
Suchauthoritycouldbeexercisedbyastate,agroup
ofstates(forexampleOSCEmembers),ortheUnited
Nationsasawhole.Theobjectivesoftheinternational
trusteeshipsystemarelistedinArticle76oftheUNCharter,
themostprominentbeing“tofurtherinternationalpeaceand
security.”Russia,UkraineandthewholeofEuropeneed
amechanismwherebythesolvingoftheCrimeaproblem
couldbetransformedintoaprocesswhichstrengthens
internationalpeaceandsecurity.Tothisend,itisbetter
toaddanewfunctiontoanexistinginstitution,ratherthan
tobuildaspecial-purposeentityfromscratch.TheCrimea
problemwillneithersinkintooblivionnorsolveitself.
