istherecognitionbytheparentstate,againstwhich

thegivenorganisationcarriesonthearmedﬁght.

Itisobviousthattheparentstatewillnotbeinterested

inawardinganyrightstothesepersons.Onecanevenclaim

thatthereisadutyonthepartofstatestocounteract

separatistmovements,giventheprincipleofterritorial

integrityandthenon-existenceofanyobligationthat

ﬁghters/terroristsaretobegrantedprotection.Weomithere

recognitionresortedtounderpressurefrominternational

society.

Thisremarkisoffundamentalsigniﬁcancefor

theassessmentofmanyfactualsituationsconnectedwith

secession.Itisveryrareforseparatisttrendstoemerge

suddenly–thesituationinCrimeaandineasternUkraine

isfromthisperspectiveaveryspecialone(nevertheless,

itishighlyprobablythattheseconﬂictswereevokedthrough

Russiansupport).Ethnicconﬂictsusuallyariseoveryears,

andthisishowtheyappearinreality.Theyshouldtherefore

usuallybetreatedasdomesticaﬀairsinthemeaningofArt.

2(7),leavingexternalinterferenceofeverykindasout

ofthequestion,inrelationtoboththeUN(SecurityCouncil,

GeneralAssembly,SecretaryGeneral),andotherstates.

Anexceptionmaybemadeinfavourofthepositions

ofregionalorganisations,andmostespeciallytheones

ofwhichthegivenstateisamember.Thiscanjustify

aninterestonthepartofthesaidorganisationintheinternal

situationofthememberstate,ifitﬁtswithintheframework

ofitscompetences.Thus,forexample,one

oftherequirementsforEuropeanUnionmembership

isademocraticformofgovernmentandtheprotection

ofhumanrights,hencecompetentEUorgansmaypay

attentiontoinfringementsthereof,and,under

certainconditionsstipulatedinitstreaties,mayevenimpose

sanctionsuponthestateresponsibleforviolations
