orthepoliticalunity,sovereigntyandindependence

ofstates.ThispositionwasrepeatedinArt.

46ofthe2007Declaration19,whichgoesfurtherthan

Declaration2625,inthatitprohibitsdismemberment

ofterritorialintegritybypeoples,groupsandindividuals.

InthecourseofpreparatoryworkontheDeclaration,

discussionpaidattentiontoacertaindichotomy

ofunderstandingoftheinterrelatednatureofthetwo

principlesmentioned:eitherinternationallawisneutral

towardssecession,orsecessionisillegal,despitetherare,

quitenarrowly-deﬁnedexceptions.Intheviewofthepresent

author,thelatterpresentedapproachisright,and

exceptionsshouldbeconstruedinaparticularlyrestrictive

way.However,thisstandpointunderminesthecreation

ofKosovo.Itshowsthattherighttoself-determinationisnot

absolute,ifSecurityCouncilResolution1244dated10June

1999conﬁrmedSerbiansovereigntyoverKosovo,thoughdid

notpreventthesubsequentseparationofthisprovincefrom

Serbia.

Ininternationallegalwriting,attemptshavebeenmade

toreconciletheprinciplesofterritorialintegrityandself-

determination.WeagreewithJ.Dugard20thateven

ifinternationalpracticehasaﬀordedtherighttoself-

determinationthestatusofperemptorynorm,theprinciple

ofterritorialintegritymustbegrantedthesamerank(this

isageneralruleofeverylegalorder).Itisalsoplausiblethat

themajorityofstates–incasesofconﬂictbetweenthese

twoprinciples–wouldassignprioritytoterritorialintegrity.

PolishauthorJ.Tyranowski21presentedamostinteresting

approach,observingthatinconsistencybetweenthesetwo

principlesisvirtual,iftheterritorialintegrityrelates

tostates,andtherighttoself-determinationtopeoples.
