example,inAfghanistan.Intheinitialphase,specialforcessoldierswere
assignedtothetasksthatcouldbeperformedbyconventionalmilitary
units,suchasprotectionofbases,butovertimethesituationchanged.Their
actionscontributedtostabilisingthesituationintheregionandindirectly
resultedinincreasedinternationalsecurity.Duringtheoperations,soldiers
releasedhostagesandconfiscatedweapons.Inthiswaytheydisruptedthe
opponent,becausethelossesincurredbyterroristsledtothedepreciation
ofthepositionoftheleadersoftheterroristnetworks.Inadditiontospecial
operations,soldierswerepreparing“AfghaniTigers”officerstocarryout
activitiesindependently,andtoensuresafetyafterthecoalitionforcesleft
theregion.CooperationofsoldierswiththeAfghanofficersistheproof
ofsuccessinbuildingpositiverelationships.Implementationofspecial
operationsbyspecialforcessoldiersledtotheirgainingnewexperience,
andtothemodernisationofarmamentsandverificationofprocedures.The
activitiesconductedprovedthatPolishspecialforcesareareliablepartner.

Thispaperisdevotedtoanalysingthefactualandpotentialinfluenceof
theInternationalCriminalCourt(ICC)inaconflictandpost-conflict
environment.ItisarguedthattheICC’scapacityhastobemeasuredbyits
abilitytotacklethe“hard-cases,”bothgeopoliticallyandlegally,andto
serveasarealmeansofimplementingtransitionaljusticestrategiesapplied
bypost-violencesocieties.TheinitialevaluationoftheICC’scapacityinthe
fieldofinternationalandtransitionaljusticeiscomparedwiththecurrent
situationinUkraine,sinceKyivhaslodgedtwoadhocdeclarationsunder
Article12(3)oftheRomeStatute.Thefirstacceptedthejurisdictionofthe
ICCwithreferenceto“Maidancrimes”thatoccurredduringthewinter
of2013to2014,andthesecondcoversthepossibilityofcrimesagainst
humanityandwarcrimescommittedinthecourseofwarfareintheDonbas
region.Undoubtedly,carefulanalysisoftheICC’spresenceintheUkrainian
crisisisrequired.

SincetheBalkanWarsinthe1990s,SerbiahasbeenperceivedbyEuropeas
itsenfantterrible.ThisisaneffectofSerbianwarcrimes,ofanunwillingness
tocooperatewiththeInternationalCriminalTribunalfortheformer
Yugoslavia,andgeneralreluctancetowardsWesternpoliticalstructuresin
Serbiansociety.ThetensionbetweentheWestandSerbiagrewparticularly
highin1999duringtheNATObombingofYugoslavia,andin2008when
Kosovoproclaimedindependence.Inspiteofthesetensions,withinlastfew
