Theselectionfunctionisaconsequenceoftheregistrationandlaw-making
functionofpublicregisters.Thisfunctionimpliesthatinordertoengagein
businessoperation,itmaybenecessarytobeenteredinapublicregister.For
example,itmaybenecessarytoobtainanentryintheregistertoundertake
commercialorgeneralbusiness.Inthepast,suchafunctionwasfullledby,for
example,anentryonthelistofguildmembers,grantingtherighttopractice
aparticularprofession.Therefore,theselectionfunctionisakindofseparationof
beneciariesofcertainrightsorprivilegesfromthosewhohavenotbeengranted
them.Theselectionfunctionisalsocloselyrelatedtothecontrolfunctionofthe
register.Theideais,afterall,tolimitadministrativecontrolovertheactivitiesof
personssolelytocheckingthelegalityoftheactivitiesundertaken.Theregister
isthusdesignedtoeliminatediscretionaryornon-legalchecks.Thismeansthat
ifcertainentitiesareregistered,anyonewhomeetscertainformalconditions
shouldbeenteredintheregisterandmayengageincertainlinesofbusiness.16
Thescalfunction,ontheotherhand,impliesthatthepersonsconcerned
areusuallypreparedtopayanadditionaltaxorfeetobeenteredintheregister.
However,itshouldbeborneinmindthatregistrationinmanyregisters,in
particularadministrativeregisters,doesnotinvolveadditionalfeesbecause
registrationactivitiesarepartofthecurrenttasksoftheadministrationandthere
isnoreasonforthebudgettoderiveadditionalrevenuefromthem.17
Whereassomeofthefunctionslistedareinconictwithothers,ormay
notbereconciledcompletely,e.g.theinformationalandprotectivefunctions,it
isdiculttondaregisterwhichfullsallthefunctionslisted.However,their
discussionisimportant,giventhesubjectofthisbook,becauseboththePrussian
(andmorebroadlyGerman)registersandthePolishregisters,whichwerelargely
basedonthem,invariablyservethesamefunctionsasdiscussedabove.
Anotherimportantissuewhenconsideringthenatureofpublicregisters
isthequestionoftheirtypology.Twobasicgroupsofpublicregisterscanbe
distinguished.Theformerservestodisclosetherightsinreminpropertywhose
peacefulenjoymentisofgreatimportancetosociety.Thebooksofthisgroup
protectowners,pledgeesorotherusersbydisclosingandrecordinginwriting
thecreation,transferandextinctionofrightsinremrelatedtotheproperty.This
groupmaybereferredtoaspublicpropertyregisters.Theyinclude,amongother
things,landregisters,theregisterofmaritimevessels,theregisterofpatents
ortheregisteroftrademarks.Thelatter,ontheotherhand,aimstodisclose
