Irrespectiveofthetypologyofpublicregisters,twobasicmodelsoforganisation

ofpublicregisterscanbedistinguished,occurringduetothediﬀerentmethodsof

collectionandmaintenanceofinformationabouttheregister,theseare:

1.amodelforthecollection,indexingandstorageofdocumentsoriginating

fromoutside;

2.amodelinwhichtheinformationcontainedinthedossierisprocessed

andspeciﬁcinformationisenteredintheregisteronthebasisofthe

documentssubmitted.23

Themodelbasedonthecollectionofdocumentsappliestheconceptof

notiﬁcation(notiﬁcationregisters).However,itshouldbeborneinmindthat

notiﬁcationisinfacttheoﬃcialcommunicationofacertainpieceofinformation

fromthesendertotheaddressee,whereastheseregistersonlyactasan

intermediaryandwhattheycollectaredocumentsconﬁrmingtheexistenceof

certainfactsortheperformanceoflegalactsbyothers.Furthermore,notiﬁcation

asanoﬃcialcommunicationmayleadbothtotheregistrationofadocumentin

aﬂregisterofdocuments”andtoanentrybeingmadeintheregisterintheusual

way.24

Thereisalsoasolutioncombiningtheelementsofentryanddepositof

adocument(notiﬁcation).Thesearetheso-calledtranscriptionregisters.Their

maintenanceconsistsinmakinganentryintheregisterbooks,wherethesubject

oftheentryisthefullcontentofthedocumentsubmittedtotheregistration

authority.Theauthoritymaynotcorrectormodifythetransferredcontent,

itsroleislimitedonlytopublicdisclosureoftheactmadebyotherpersons.In

Poland,thisiscurrentlyappliedinmaritalstatusregisters,wheretranscriptionis

theenteringintotheregisterofthecontentofaforeigncopyofamaritalstatus

registerrecord.25

Themostcommonpracticeistocombinebothmethodsofrecording

dataintheregister:makingentriesandacceptingdocumentsintotheregister

ﬁles,whileassumingthattheircontentisnotthesubjectoftheentry,andthe

registrationauthoritykeepsthemintheﬁlesduetotheprincipleofopenness.26

ForbothPrussianandGermanregisters,wewillprimarilyencounteramixed

modelofkeepingregisters.Inalloftheregistersinquestion,thebasisforentry

wasandisessentiallydocumentsordeclarationssubmittedtotheregistration
