facts.Thiswasparticularlytrueinthecaseofpropertyrightsandencumbrances
onrealestate.1Asonecouldnottrustallthesefactstohumanmemoryalone
inexpandingcommunities,varioustypesofregisterswerecreatedovertimeto
recordthenecessaryinformation.Althoughtheexactoriginofmanyregisters
remainsdebatable,2thereisnodoubtthatastimepassedandrelationsbetween
peopledevelopedandthelawdescribingthembecamemorecomplicated,new
publicregisterswerecreatedanddeveloped.Therefore,thisissueofpublic
registersisnotnewbecauseitsoriginsdatebackatleasttoancientBabylon.3
Duetosuchanoldpedigree,thequestionofpublicregistershasalready
beendiscussedonmanyoccasionsinlegalandhistoricalliterature.However,
theliteraturesofar(notonlyinPoland)hasfocusedmainlyontheproblems
associatedwithindividualpublicregistersorontheirgeneraltheory.However,
notallregistershavebeendevelopedequally.Mostoftheexistingstudiesconcern
themaritalstatusregistry,cadastreandlandregisters,aswellascommercial
andcooperativeregisters.Smallerregisters,withspecicpurposes,havereceived
relativelylittleattention.Regardingancientregisters,itisworthmentioning
publicationssuchasAncientLandLaw:Mesopotamia,Egypt,IsraelbyRobert
C.EllicksonandCharlesDiAThorland(Chicago-KentLawReview,Vol.71,Issue1,
1995)andArchiwawpaństwachstarożytnychbyMieczysławRokosz(Archeion,
