Introduction
ItshouldbeemphasisedthatPolandconstitutesaspecialcasewhendiscussing
problemsoflawdevelopmentinthe20thcentury.Thisisduetoanextremely
troublesomelegacyofthepartitionera,namelythefactthatthelawwasdivided
intodistricts,whichpersistedthroughouttheentireinter-warperiod.Intherst
periodofexistenceofrebornPoland,insomeareasofthestate’sfunctioning,one
couldndasmanyasvedierentlegalsystemsinforcesimultaneously.This
problemwasnotsolvedbeforetheoutbreakoftheSecondWorldWar,despite
theappointmentoftheCodicationCommissionin1919,whosemissionwasto
preparedraftsofuniformlegislationforallthelandsconstitutingtheState.Itis
worthnotingthattheCodicationCommissionactedbothintheeldofciviland
criminallaw.4
Lookingattheareaofpublicregistration,itseemsthatboththeCodication
Commissionandthepost-warauthoritieswereparticularlykeentodrawonthe
legalsolutionsinforceontheterritoryoftheformerPrussianpartition.Thus,
thesewerelegalsolutionsinforcebothintheKingdomofPrussiaandoften
morebroadlyalongtheentireGermanEmpire.ThisState,thankstothecreation
ofamodern,ecientbureaucraticmachineandanabsolutistapproachtothe
questionofthestate’sinuenceonitscitizens,5hadnotonlytheneedbutalso
theopportunitytorecordmanyfactsthatwereimportantforrelationsbetween
citizensandbetweentheStateandcitizens.Indeed,thesefactorsmighthavebeen
decisiveforthedevelopmentinPrussiaofaparticularlyecientandmodern
systemofpublicregisters.
ItisthisnoticeableinuenceofthesolutionsappliedinPrussiaonthePolish
legislation(especiallyaftertheSecondWorldWar)thatledtothecreationofthis
monograph.ItsrstandprimaryobjectiveistopresentthePrussianregisters
asasystem.TheotheraimistotracetheinuenceoftheGermanmodelson
thedevelopmentofpublicregistersinPolandandtheirpresentshape.Taking
upthistopicseemsallthemorejustiedbecauseoftheincreasingopennessof
archives,givingawiderangeofusers,includinggenealogiststoalargeextent,
thepossibilityofresearchingthepastnotonlywiththehelpoftraditionally
usedsourcesbutalsowiththehelpofregisterswhichcanconstituteexcellent
supplementarymaterialinmanytypesofresearchundertakenbyhistoriansand
representativesofhistoryauxiliarysciences,bothprofessionalandamateur.
Inordertofullymeetthisobjective,thesystemanalysismethodwasadopted
asthebasisforthestudy,whichaimstopresenttheindividualelementsofthe
