Introduction

ItshouldbeemphasisedthatPolandconstitutesaspecialcasewhendiscussing

problemsoflawdevelopmentinthe20thcentury.Thisisduetoanextremely

troublesomelegacyofthepartitionera,namelythefactthatthelawwasdivided

intodistricts,whichpersistedthroughouttheentireinter-warperiod.Intheﬁrst

periodofexistenceofrebornPoland,insomeareasofthestate’sfunctioning,one

couldﬁndasmanyasﬁvediﬀerentlegalsystemsinforcesimultaneously.This

problemwasnotsolvedbeforetheoutbreakoftheSecondWorldWar,despite

theappointmentoftheCodiﬁcationCommissionin1919,whosemissionwasto

preparedraftsofuniformlegislationforallthelandsconstitutingtheState.Itis

worthnotingthattheCodiﬁcationCommissionactedbothintheﬁeldofciviland

criminallaw.4

Lookingattheareaofpublicregistration,itseemsthatboththeCodiﬁcation

Commissionandthepost-warauthoritieswereparticularlykeentodrawonthe

legalsolutionsinforceontheterritoryoftheformerPrussianpartition.Thus,

thesewerelegalsolutionsinforcebothintheKingdomofPrussiaandoften

morebroadlyalongtheentireGermanEmpire.ThisState,thankstothecreation

ofamodern,eﬃcientbureaucraticmachineandanabsolutistapproachtothe

questionofthestate’sinﬂuenceonitscitizens,5hadnotonlytheneedbutalso

theopportunitytorecordmanyfactsthatwereimportantforrelationsbetween

citizensandbetweentheStateandcitizens.Indeed,thesefactorsmighthavebeen

decisiveforthedevelopmentinPrussiaofaparticularlyeﬃcientandmodern

systemofpublicregisters.

ItisthisnoticeableinﬂuenceofthesolutionsappliedinPrussiaonthePolish

legislation(especiallyaftertheSecondWorldWar)thatledtothecreationofthis

monograph.ItsﬁrstandprimaryobjectiveistopresentthePrussianregisters

asasystem.TheotheraimistotracetheinﬂuenceoftheGermanmodelson

thedevelopmentofpublicregistersinPolandandtheirpresentshape.Taking

upthistopicseemsallthemorejustiﬁedbecauseoftheincreasingopennessof

archives,givingawiderangeofusers,includinggenealogiststoalargeextent,

thepossibilityofresearchingthepastnotonlywiththehelpoftraditionally

usedsourcesbutalsowiththehelpofregisterswhichcanconstituteexcellent

supplementarymaterialinmanytypesofresearchundertakenbyhistoriansand

representativesofhistoryauxiliarysciences,bothprofessionalandamateur.

Inordertofullymeetthisobjective,thesystemanalysismethodwasadopted

asthebasisforthestudy,whichaimstopresenttheindividualelementsofthe
