theydidnothaveaccesstoanyestablishedprocedure.
Theabove-mentionedexamplesshowthatasthelawstandsthelegislatorfails
toprovideforsufficientlegalprotectionforwomenwhenitcomestomotherhood.
Eveniftherearejustifiedreasonstoterminatepregnancy,ofteninreality,awoman
isleftwithnochoice,forcedtosacrifice.
3.Interferenceofthelegislatorintheinfertilityregulations
Sometimesawoman(acouple)wantstohaveababybutduetovariousreasons
(medicaloridiopathic)she(they)can’t.However,inpracticelawdoesnothelp
either.AlthoughtheadoptionoftheLawof25thJune2015oninfertilitytreatment31
shouldbeevaluatedpositively,itisnotfollowedbythesufficientexecutivemeasures
guaranteeingwomenregularfinancialsupportfromtheStatebudgetincaseoftheuse
ofthemedicallyassistedreproductionmethods,includinginseminationorinvitro
procedures.Trulyastonishingisthatjustafewyearsagotherewasnoregulation
oninfertilitytreatmentinPoland.Thelegislatorlingeredwithregulatingthis
importanttopic.Itwasthesubjectofintensepublicinterestandnumerouspolitical
disputessincethesubmissionofthedraftandevenbefore,whichisconnectedwith
thecomplexityoftheissueofinterferencewiththenatureofhumanprocreation32.
Article1points1-5oftheLawoninfertilitytreatmentdeterminesthescopeofthe
applicationoftheact,includingthetasksofpublicauthoritiesintheprotectionand
promotionofreproductivehealth.Article3clause1ofthisLawstatesthattreatment
ofinfertilityshallbeconductedinaccordancewithcurrentmedicalknowledgeand
financedwithinthescope,inthemannerandundertheconditionsspecifiedinother
regulations.Infertilitytreatmentisfundedbutthelegislatordidnotprovidefor
generalavailabilityinthisarea-itmaybeassumedthatitiscurrentlyfinancedfrom
thepublicfundsinaccordancewiththeprovisionsoftheRegulationoftheMinister
ofHealthof22ndNovember2013onguaranteedservicesinthefieldofhospital
treatmentandsomeinaccordancewiththeRegulationoftheMinisterofHealthof
6November2013onguaranteedservicesinthefieldofoutpatientspecialistcare33.
