ourjudgementofthegivensituation,ajudgementincluding
allthevitalparametersofthesocialenvironment.Underno
circumstancesshouldcriminalpolicybebasedondatathat
areuncertainordonotpertaintotheenvironmentinwhich
thepolicyistobeimplemented.Thislastprovisiondealspar-
ticularlywiththeworryingworldwidetendencytocopyin-
discriminatelysomeoftheUScriminalpolicies.5Thereasons
forchoosingthesemodelsareseldompresentedtothepublic,
apartfrominvokingtheir“efficiency,”understoodasshort-
-termcostsavingcapacity,andthetheoreticalpremisesofthe
researchquotedtobackthemupareoftenvague.6Atthesame
time,theinformationwedopossessaboutsolutionsadopted
indifferentcriminaljusticesystemscallsforareflectionon
theirdiversityevenwithineachculture,withwhatonemight
assumetobecommonnorms,valuesandasharedbodyof
scientificknowledgeconcerningcriminalpolicy.7Meanwhile,
therationalisationsusedtosupportsomeofthenormative
andorganisationalmeasuresinthisdomainareinstarkdis-
agreementwiththecurrentstateofknowledgeaboutman
andsociety.8Suchstatements,ifnotentirelythoughtless,can
atbestbeseenasservingthepurposesofintimidationand
exclusionbutarecertainlynotinplaceinacivilisedworld,
