2.REGULATIONOFTHECLAIMFORINFORMATIONBASED
ONREGULATIONNO.2100/94ANDREGULATION
NO.1768/95ANDITSINTERPRETATION
INTHECJEU’SCASELAW
Itisessentialtocommencewiththeintroductionoftheclaimforinfor-
mationbasedontheCommunityplantvarietylaw.Hence,arathershort
preambletoRegulationNo.2100/94doesnottouchonthetopic,whereas
Art.14,para.3,indent6ofthisregulationstipulatesthefollowing:flCon-
ditionstogiveeffecttothederogationprovidedforinparagraph1andto
safeguardthelegitimateinterestsofthebreederandofthefarmershallbe
established,beforetheentryintoforceofthisRegulation,inimplement-
ingrulespursuanttoArticle114,onthebasisofthefollowingcriteria:
relevantinformationshallbeprovidedtotheholdersontheirrequest,
byfarmersandbysuppliersofprocessingservices;relevantinformation
mayequallybeprovidedbyofficialbodiesinvolvedinthemonitoringof
agriculturalproductionifsuchinformationhasbeenobtainedthrough
ordinaryperformanceoftheirtasks,withoutadditionalburdenorcosts.
Theseprovisionsarewithoutprejudice,inrespectofpersonaldata,to
Communityandnationallegislationontheprotectionofindividualswith
regardtotheprocessingandfreemovementofpersonaldata”.
Theflexemption”quotedabovereferstotheagriculturalexemption,
i.e.specifictypeoffairuseenablingtheuseofaplantprotectedwith
breeder’sright.Inpractice,itentitlesthefarmerstousetheproductof
theharvestofseveralplantspecies(mainlygrain,leguminousplants,oil
plants,potatoes)asapropagatingmaterialwithouttheconsentofthe
breeder,freeofchargeoragainstpayment(supposingthatthesizeofthe
farmsteadexceedsspecificareasetbytheprovisions).
TheRegulationNo.1768/95elaboratesonthatmatterintheChapter
4entitledflInformation”thatcoversArt.8(Informationbythefarmer),
Art.9(Informationbytheprocessor),Art.10(Informationbytheholder),
Art.11(Informationbyofficialbodies),andArt.12(Protectionofpersonal
data).However,forthepurposeofthispaper,itisnecessarytofirstlyin-
