theholder,representingthebreeder,andbythefarmerinsuchawayas
tosafeguardthelegitimateinterestsofeachother.2.Thelegitimatein-
terestsshallnotbeconsideredtobesafeguardedifoneormoreofthese
interestsareadverselyaffectedwithoutaccountbeingtakenoftheneed
tomaintainareasonablebalancebetweenallofthem,oroftheneedfor
proportionalitybetweenthepurposeoftherelevantconditionandthe
actualeffectoftheimplementationthereof”.
Theregulationoftheclaimfortheinformationcanbeexplicated,in
asomewhatsimplifiedmanner,asfollows:Art.8ofRegulationNo.1768/95
definesthescopeoftheinformationthatthefarmerisrequiredtoprovide.
Paragraph1ofthisregulationgivesprecedencetopotentialagreement
betweenthefarmerandthebreeder;intheabsenceofanagreement,the
cataloguecontainedinpara.2shallbeapplied.Paragraph2specifical-
lyencompassespersonaldetailsthatidentifythefarmer,hisfarmstead,
plantvarietybeingcultivated,aswellasthedetailsofthecontractors
involvedintotheprocessingoftheharvestingmaterialintopropagat-
ingmaterial,andultimatelythedetailsofthesuppliersofthematerial.
Paragraph3limitsthetimespanoftheinformationrequestedtothecur-
rentmarketingyearandthethreeprecedingmarketingyears.Article8of
RegulationNo.1768/95isbeingsupplementedbyArt.14,whichobligates
thefarmertodemonstratethattherelevantinformationhasbeenduly
disclosed;incaseofneed,thevarietyholdermaybeallowedtocarryout
aninspectionoflandorstoragefacilitiesinquestion.Article9ofRegula-
tionNo.1768/95definesthescopeoftheinformationthattheprocessorof
theharvestmaterialisrequiredtoprovide.Analogicallytothepreceding
article,itgivesprecedencetopotentialagreementbetweentheprocessor
andthebreeder;intheabsenceofanagreement,thecataloguecontained
inpara.2shallbeapplied.Paragraph2specificallyencompassespersonal
detailsthatidentifytheprocessorandthefarmer,forwhomtheprocess-
inghasbeencontracted.Paragraph3limitsthetimespanoftheinforma-
tionrequestedinanidenticalmannerastheprecedingarticle.Article9
ofRegulationNo.1768/95is,ontheotherhand,beingsupplementedby
Article14,whichobligatestheprocessortodemonstratethattherelevant
informationhasbeendulydisclosed;incaseofneed,thevarietyholder
maybeallowedtocarryoutaninspectionofprocessingorstoragefacili-
tiesinquestion.Article10ofRegulationNo.1768/95defineswhatinfor-
mationisrequiredfromtheplantbreederpursuingtheclaimforinfor-
mationagainstthefarmerortheprocessor.Inaccordancewithprevious
articles,itgivesprecedencetopotentialagreementbetweenthefarmer
andthebreeder;intheabsenceofanagreement,thecataloguecontained
