theemploymentrelationship,suchasisalegalbond,i.e.betweenemployeeand
employer,isgovernedbythesubstantivelawofthatMemberStateinwhichobli-
gationsunderthecontractandlabourregulationsarecarriedout.ProvisionofAr-
ticle1ofthedraftregulationof1976doesnotpayattentiontothefactofcarrying
outdutiesacutetotheemploymentrelationship.Itsetsouttheobligationsonthe
individualpagesoftheemploymentrelationship.Sinceeveryemploymentrela-
tionship,inparticular,thebindingrelationisbasedonreciprocalbenefits,there-
fore,examiningtheprovisionofArticle1couldbeappliedonlyiftherightsand
obligationsofpartiestoindividualemploymentrelationshipshavebeencarried
outsymmetricallyinthesameMemberState.Teobviousshortcomingofthe
proposedregulationwasnottocoverauniformsetofconflictrulesofindividual
employmentrelationships,inwhichpartoftheobligationsofthepartieswas
madeinanotherMemberStateorthirdcountry.Asattemptedtosubmitearlier,
therulesofprivateinternationallaw,jurisprudence,doctrineoftheEuropean
countries,aimtodevelopacharacteristicindicatorforcontractualrelations,the
useofwhichallowsforidentificationofapropernationalsystemofsubstantive
law.InArticle1ofthedrafttherewasnomentionofbenefits,asthedeciding
elementoftheprovisionisitsconflictoflawsaspect,characteristictobinding
workrelationships.Teuseoftheplural“obligationstobeimplemented”proves
thattwoormoreobligationsofthedraftregulationwouldonlyapplytothose
contractsofemploymentwithaninternationalelement,inwhichtherespective
obligationsofthelegalrelationshipwillbeimplementedinoneMemberState.
Althoughtheoriginalintentionofthelegislaturewastoapplytheprovisionsof
thedraftregulationtoall,withoutexception,labourrelations,exclusionswould
includeanylabourrelations,inwhichtheemployeewouldberequiredtoperform
workontheterritoryofaMemberStateX,inreturnforwhichtheemployer
wouldbeobligedtopaythatemployeeintheStateofY.Itcanbeconcludedthat
theregulationwouldnotapplyifitwasenacted,toemployeespostedtoworkin
anotherMemberStateortheother,temporarilyperformadhocactivitieswithin
theterritoryofanotherstate.
Article1ofthedraftregulationusesthephrase“allemploymentrelation-
ships.”Suchatermmaybetreatedasanindicationthatthebillintendedtoapply
regulationconflictnotonlytotherulesgoverninglabourrelationsofobligations,
butalllegalrelationshipsgovernedbylabourlaw,irrespectiveoftheirlegalbasis.
Despitetheabsenceofaformalequalityinofciallabourrelations,characteris-
ticofthelegalrelationshipsregulatedbylabourlawistheequalityofbenefits.
Workersemployedinthepublicserviceinexchangeforstayingatthedisposal
oftheemployerandthejob,providedtheyacquiretherighttoremuneration
(salary)andotherbenefitsregulatedbyrelevantprovisions,whichdetermine
thepositionofemploymentandworkers’rights.Insuchofciallabourrelations
wherethereareelementsofforeignconflicts,nationallegislationusedtoregu-
latetheemploymentsituationofcivilservants,ofcersandotherworkersinthe
