aimatobservingthelawandprinciplesofconstitution.Administrative
controlmayincludethecontrolofintentexecutedbytheauthority
ofahigherrank,withreferencetothetasks,performanceofwhichhas
beendelegatedtolocalcommunities(article8section1and
2ofECLSG).
Localcommunitieshavetheright,withinthenationaleconomic
policy,topossesstheirownsufficientfinancialresourceswhichthey
canfreelyusewithintheframesofexercisingtheirpowers.Whilethe
amountoffinancialresourcesoflocalcommunitiesshouldbeadjusted
totherangeofpowersgrantedbyconstitutionandbylaw(article
9section1and2ofECLSG).ProvisionsoftheChartershowthat
atleastpartoffinancialresourcesoflocalcommunitiesshouldcome
fromlocalfeesandtaxes,theamountofwhichcanbedetermined
bycommunitieswithintherangeprovidedforbythelaw(article
9section3ofECLSG).Financialsystems,onwhichresourcesbeing
atthedisposaloflocalcommunityarebased,shouldbesufficiently
variedandflexiblesothattheycouldpossiblycorrespondtothereal
changeswhichundergoatthelevelofcostsconnectedwithexercising
ofpowers(article9section4ofECLSG).Moreover,local
communitiesshouldbeconsulted,inasuitablemode,asfortheforms
ofgrantingthemresourcescomingfromredistributionofincome
(article9section6ofECLSG).
Localcommunitiesexercisingtheirpowershavetheright
tocooperatewithotherlocalcommunities,aswellasassociatewith
themwithintherangeprovidedforbythelaw,inordertoperformthe
taskswhicharethesubjectoftheircommoninterest(article10section
1ofECLSG).
Pursuanttoarticle11ofECLSG,mentionedcommunitieshavethe
righttoappealatcourtinordertoassurefreeexercisingofpowersand
respectingoftherulesoflocalself-governmentwhichareprovidedfor
intheconstitutionorinternallaw.
Therulesoffunctioningoflocalself-governmentpresentedabove
hadanessentialinfluenceoninternallegislationofEuropean
countries,especiallythatofFrance,Spain,GermanyandPoland.
