6.Gender-neutraland/or“third-sex”

Thereisneitheragender-neutralnora“thirdsex”possibilityinPoland.In

caseofintersexnewborns,themedicalpersonnelthatassiststhedeliverywould

berequiredtodecidewhichsexfeaturesarepredominantinordertomarkthe

maleorfemalesexinapropermedicalform(thebirthcard).Thisdataislater

recordedintheCivilStatusRegisterwhenmakingoutthechild’sbirthact.

Thesituationofintersexpersonsisnotregulatedbythelaw.Theproblem

attractslessattentionthanthetranssexualscases.Alsohere,itisthejudiciary

thathaselaboratedsomepracticalanswerstoquestionswhicharisewhenthe

psychologicalsexturnsouttobediferentfromthesex“chosen”forthechildat

thetimeofbirth.Interestinglyenough,inthisparticulartypeofcasesthelegal

solutionappearstobediferentfromtheconceptappliednowadayswithregard

totranspersons.Moredetailsconcerningthetoolsavailabletointersexualpeople

aregiveninsection11below.

7.Accesstotreatments

Transsexualism,accordingtointernationalstandards,isadisorderwhich

deservesmedicaltreatment.Itisclassiﬁedasoneofthementalandbehavioral

disorders.33Transsexualpersonsneedmedicalassistanceinmanyrespects.This

includesnotonlyhormonaltherapyoradaptationsurgeriesbutalsoaneedfor

variousmedicaltestsaswellasprofessionalconsultationswithspecialistssuchas

sexologists,psychologists,endocrinologistsorevenoculists.34Theseneedshave

notbeenacknowledgedbythePolishlegislator.Currently,transsexualismassuch

doesnotjustifyaccesstoanydedicatedmedicalprocedureswithinthepublic

healthsystem(ﬁnancedbytheState).Thismeansthat,generally,thepatientmust

payfullcostofallspecialtreatments.35Ontheotherhand,ifatranssexualperson

possessesadequateﬁnancialresourcesandisdeterminedtogetappropriatehelp
