Publicregisters
Thefirstchapterwilldefineapublicregisteranditsbasicfunctions.Thechapter
willalsodealwiththehistoryofthedevelopmentofpublicregistersinEurope
untiltheendofthe19thcentury.Thepresentationofbothissuesisnecessaryto
structurethesubsequentlecture,whichwillbestronglybasedonthefindings
presentedinthefirst,somewhatintroductory,chapter.
1.1Publicregisters–defnition,typology,functions
Throughouthistory,aregister(regester,registreorregiestre)wasusuallycalled
alist,indexorinventoryofpeopleorthings.SamuelBogumiłLinde,forexample,
explainedthataregisterisflalistofvariousthings,inordertoremember,findand
recallthemmoreeasily”
.1However,theconceptofaregisteralsopertainedtothe
applicationoflawandtheoperationofpublicoffices,especiallycourts.Registers
werealsovarioustypesoflists,inventoriesorrepertoriesofdocumentsdrafted
orreceivedinchancelleries,offices,etc.Whenusingspecificterminology,an
importantfactorwasalsothetechniqueofcollectinginformation,duetowhich
datasetskeptforthepurposesofjudicial,administrativeorfiscalpracticewere
oftencalledbooks.SuchbookswereknownandkeptasearlyasintheMiddle
Ages.InPoland,theseweree.g.towncouncilbooksandmunicipalcourtbooks,
whichwereusedtorecordlegalfactsimportanttotheinhabitants,suchas
thecompositionofelectedauthorities,adoptedresolutionsoftowncouncils
orcourtjudgements.IntheOldPolishera,thetermsbookandregisterwere
notsynonymous.Onthecontrary,onecaneventalkabouttheinferiorityof
