Publicregistersthusserveﬁrstandforemosttoprovidereliable,most

credibleinformation.Anentitywithsuchknowledgeisabletomaketheright

decisionsandassesstheriskofenteringintoaspeciﬁccontract,acquiringathing

orassumingaright.6

Thepurposeofpublicregistersisrelatedtotheirfunctions,whichmay

include:record-ﬁling,information,alert,protection,control,law-making,

selectionandtaxation.7

Therecord-ﬁlingfunctionissometimesalsoreferredtoastheregistration-

entryfunctionortheregistration-documentationfunction.Thisfunction

arisesfromthefactthatitisthetaskoftheregistryauthoritytocollectcertain

informationandrecorditbymakingappropriateentriesintheregisterbooks

andbypreservingdocuments.Inrelationtothisfunction,itisassumedthatthe

primarypurposeoftheregisteristomaintainacompleteandreliablyordered

collectionofinformationofaparticularkind.Forsomeregisters,theprinciple

ofcompletenessisadopted(thatis,alldatatoberegisteredmustberecorded

andconsequentlydisclosed,andonlythosedatawhichhavebeenrecordedand

disclosedproducelegaleﬀects).However,therearealsoregisterswhichdo

notassumecompletenessofthesetofinformation.Currently,suchasituation

occursforinstanceinrelationtolandandmortgageregisters,becausePolish

legislationhasnotadoptedtheprincipleoftheiruniversality.Therecord-ﬁling

functionmayalsoconsistintheregistryassigningidentiﬁcationnumbersor

symbols,whicharethenusedinotherareasoflife,includingotherregisters.

ExamplesincludeidentiﬁcationnumberscommonlyassignedinPoland:

PESEL,REGONandNIP.8

Theinformative(disclosing)functionoftheregisterisimplementedin

thefactthatthankstotheregistertheinformationisavailableaboutpersons,

theirrightsorthings,theirlegalstatus,andtosomeextentalsothefactualone

inaspeciﬁcareamaybedetermined.Theinformationfunctionoftheregister

isaconsequenceoftheprincipleofopenness,andinparticularoftheformal
