containedinabook.Itwascourtregisters,suchastheabovementionedtown

andlandregisters,whichhadagreatinﬂuenceonthecontemporarymeaning

ofthetermpublicregister.2

InPolishlegislation,however,ithasbecomecommonpracticetodistinguish

betweenaregisterandarecord.Thisdistinctionisbasedontheextentof

controlthattheentitykeepingsuchrecordshasoverinformationordocuments

submittedbypersonsorinstitutionsentitledorobligedtodoso.Whenthebody

thatmaintainstheinformationﬁlecontrolsthecontentofthedocumentsor

informationsubmitted,sothatitcanrequirecertainamendmentstobemade

tothem,orcanitselfmakeinterpretations,orwhenitcanrefusetopublicly

discloseinformationoradocumentbecauseofitscontent,suchaninstitutionis

usuallycalledaregister.Arecord,ontheotherhand,isreferredtowhentherole

ofauthorityistotakenoteofinformationordocumentsandpubliclydisclose

theircontents.Itisalsocommonlyinterpretedthataregisterissaidtoexist

whenacertainregisterorbookisrecognisedbylawasservingtorecordfactsor

documentswithaspeciﬁclegaleﬀectofthatrecording.3

AfterTomaszStawecki,itmaybeassumedthatapublicregisterissuchaﬁle

ofinformationonpersons,thingsorrights,whichmeetsthefollowingconditions:

1.itisestablishedundertheapplicablelaw,

2.itisoperatedbyaregistrationauthorityofapublicnature,

3.thereceipt,recordingandsubsequentdisclosureofcertaininformationis,

inprinciple,theresultofadecisionoftheregistrationauthority,

4.thekeepingoftheregisterandthedisclosureofcertaininformationinit

produceslegaleﬀects,

5.itispublic.4
