1.Contractofsaleisoneoftheoldestlegalinstituteswhichwasrelativelywell-deve-
lopedalreadyintheRomanlaw.Romanlawisconsideredtobeoneofthegreatestcon-
tributionsoftheRomanEmpireforthegenerationstocome.JustastheGreekantiquity
iswellknowntobeacontributionmainlyintheareaofphilosophy,theRomanantiquity
hasenrichedespeciallylawandlegalthinking.Thisisprovedtobetruemainlybythe
factthatevenafteranactualdeclineoftheRomanEmpire,evenofitseasternpart,Ro-
manlawkeptinfluencinglegalthinkingsignificantly.Thistendencycouldbetraced
fromtheoldesttimestillpresentandSlovakia,BohemiaandMoraviaarenoexcep-
tionsfromthisstatement.
RomanlegalthinkingandinstitutesoftheRomanlawwereandareinsofarorga-
nicpartoflegalsystemsofEuropeancountries,thateventheCommunistPartyofthe
CzechoslovakRepublicwasnotabletodocompletelywithoutthemwhenmakingnew
unifiedcivilcode(lawnumber141/1950Zb.,CivilCodepassedonOctober25,1950),
whichmeanttheendofahistoricalperiodoflegaldualismintheCzechoslovakRepublic
wheninBohemiaandMoraviawaseffectiveAustrianCivilCode(ABGB)asamended
andinSlovakiaHungariancustomlaw.Thisnewcivilcode,alsocalled"themedium
code”,originatedwithinso-calledlegalbiennium(1948–1950)declaredbytheCzecho-
slovakgovernment.ElementsofRomanlawcouldbefoundhereinspiteofatotally
differentoveralllegalconceptandtendencytoassimilateCzechoslovaklegislationin
thegreatestpossiblemannerwiththesovietcivillaw.Thus,eventhoughthebasicrole
oftheCivilCode1950fromthecontentpointofviewwastoprojecttheprinciplesof
theConstitutionoftheMay9concerningespeciallyeconomicpolicyintospecificand
detailedregulationofproprietaryrelationships,manyoftheprinciplesandinstitutesof
theRomanlawwereretainedevenifwrappedupinsocialisticlanguage1.
