Therealpossibilityofrealizationanddefenseofbasicrightsofmanispro-
videdaconcretepersonaboveallthingsbythelegalmechanismsofthe
state.Providingofrightsandfreedomsofmanisconditioning,necessary
forrealizationhumanrights,anddirectionsofgovernmentactivityare
providingofrealizationofhumanrights,guardanddefenseofrightsand
freedomsofman.Exactlythestateisunderanobligationtoprovideeve-
rybody,ifitsrightsarebroken,effectivefacilitiesoflegaldefense.
Legalmechanismofprovidingofhumanrights—oneofimportantfa-
cilitiesofinfluence,controlprocessofproviding,whichisbuilt-ininthe
structureofprovidingofhumanrightsandoperatesformaintenance
ofitthenormalstablestate,removalsofdefects,whichappear1.
Themajorfactoroftherealprovidingofrightsandfreedomsofman,
nexttotheirconfession,observanceandrespect,guaranteeing,which
iscarriedoutbyspecificfacilities—guarantees,whichgiveallelements
oflegalstatuspersonsoftherealmaintenance,duetowhichunimpeded
realizationofrightsandfreedoms,theirguardfrompossibleillegalen-
croachmentsanddefense,becomespossiblefromillegalviolations,is.
Takingintoaccountdifferencesinguaranteeing(providing)ofhuman
rightitispossibletodivideintotwogroups.Rightsforrealizationofwhich
insocietybelongtofirstfromthem,inthestatealreadythereareneces-
sarytermsandfacilities(foremost,termsareeconomic,material),orre-
alizationofwhichdoesnotrequireperceptiblefinancialchargesfromthe
sideofcitizen.Tothisgrouprightsbelongmostlypersonalityandpoliti-
cal.Oneofthemostconvincingindexesofsocialrealizationofsuchrights
thereisthatitispossibletosetthereallegalguaranteesoftheirfunction-
ing,guardanddefense.
