freedomsofman.Forjurisdictionactivityitisconferredtherightthecircle
ofpublicservantsoforgansofinternalaffairs,whichexpressthereac-
tionofthestateonanotlegalconductbytakingawayofimperiousact,
isexpresslycertainalegislation,executingthecertainformofinfluence
ontheconductofpersonthus,educatingitinaspiritrespecttothelaws,
warningoffeasanceoftherepeatedoffences.
Considerablepartofrelationsinrelationtoprovidingofrightsandfree-
domsofmaninthefieldofpublicpeaceandsafetyisprovidedthenorms
ofadministrativelaw.Carryingouttheanalysisofessenceofthesere-
lations,itfollowstogooutfrompositionthe«stateispersonality»,and
inwhichthestatecomesforwardonbehalfofsociety,andpersonality
asamanisprovidedwithconcreterightsanddutieswhichmakeitlegal
status.Questionofprovidingofrightsandfreedomsofmaninthegeneral
contextofproblemsofitlegalstatusitremainsoneofmostactualand
meaningful,themoresoonthestageofforminginUkraineofthelegal
state.Withoutregardtowidedevelopedofthisthemebylegalscience,
roundthesequestionsnumeraldiscussionsprecedetothistime.
Onthewhole,mechanismofprovidingofrightsandfreedomsofman
inactivityoforgansofinternalaffairsitispossibletopresentastwosub-
systems.Firstisthesystemofguard,whichincludesforitselflegalfacili-
tieswhichsetthelimitsoflegallimitationtheorgansofinternalaffairs
ofindividualfreedomofcitizens(facilitiesofguaranteeing)andproviding
oflegalityduringapplicationofmeasuresofcompulsion,thatlimitsuch
freedom(facilitiesofguard).Secondisthesystemofdefense—makes
unityoflegalfacilities,whichprovideproceedinginthebrokenright,
bringingin,toresponsibilityofguilty,compensationofharm,causedof-
fence(facilitiesofguaranteeing),andorganizationofactivityoforgans
ofinternalaffairs,inrelationtorealizationoflegalfacilitiesofdefense
ofrightsandfreedomsofman(facilitiesofdefense).Thenecessityofap-
plicationoffacilitiesofdefensearisesupinthecaseofviolationofrights
andfreedomsofmanthepublicservantsoforgansofinternalaffairs.The
useofinternalaffairsofthenotedmeasuresorgansisregulatedlawsand
otherlegalacts,whicharecomplementedorganizationalandcontrol-ob-
servantbyactivity,whichallowsrealizingthereallegalactsandthesame
topreventillegalencroachmentfromthesideofseparatepeople,public
servants,onrightsandfreedomsofman.
FunctioningofUkrainiansocietyinthehigh-qualitynewstatetakes
placeatpermanenteconomicandsocio-politicalchangesthatforesees
thenecessityofprovidingofpubliclaw,personalsafetyofcitizens,all
patternsofownershipandvitallyimportantinterestsofsocietyand
stateenforcement.Forthisreasonlocationoforgansofinternalaffairs
inUkraineisdeterminedthethembyafunctionalorientationon:defense
ofrightsandfreedomsofman,proclaimedConstitutionofUkraine,laws
ofUkraineandinternationalagreementsofUkraine;preventionviolation
ofrightsandfreedomsofmanandassistancetheirrenewal;realization
operativelyofficialtoactivityinaccordancewithConstitutionofUkraine,
legislation,internationalstandards,inthisindustry;animprovementand
