Theissuespresentedabovearecentraltounderstandingwhatpublicregisters

areandwhattheyarefor.Althoughtheseconsiderationsarebasedmainlyon

contemporaryPolishlegalthought,theyaresouniversalthattheycanalsobe

successfullyappliedtotheregistersofthe19thcenturyintheKingdomofPrussia

andlaterintheGermanEmpire.Thustheymakeitpossibletospecifytheregisters

tobethesubjectofthisbook.Thesewillbe:maritalstatusregisters(Geburts-,

Heirats-,Sterbe-Register),landregisters(Grundbücher),landandbuildingtax

cadaster(Grund-undGebäudesteuerkataster),registersofcommerce,associations

andcooperatives(Handels-,Vereins-,Genossenschaftsregister),registersof

specimens(Musterregister,dieRollefürGebrauchmuster),trademarkregister

(Zeichenrolle)patentregister(Patentregister),registerofmatrimonialproperty

1.2Historyofpublicregistersuntiltheendofthe19thcentury

Thetypology,functionsandmeaningofthenotionofapublicregisterresultfrom

thehistoricaldevelopmentofthislegalinstitution.Forthisreason,presentingthe

historyofregistersisimportantalsobecausemodernpublicregistersarestrongly

rootedintheirhistoryandinheritmanyideasandsolutionsofthehistoriclaw.32

DemonstratingtheconnectionbetweenmodernpublicregistersinPolandand

theirpredecessorsisalsoabasicassumptionofthisbook.

Landregistersandcadastresprobablywereﬁrsttobecreatedofallpublic

registers.Ontheotherhand,registersrecordinginformationonpersons,their

maritalstatusandlegalstatus,including,interalia,maritalstatusregisters,have

amuchshorterhistory.33

landwasintendedtoprovideevidenceofownershipofrightstoaplotofland
