1.2Historyofpublicregistersuntiltheendofthe19thcentury
describedanddemarcatedinspaceandtogivetheowneraguaranteeofthe
inviolabilityofhispossession,thusformingthebeginningsofmodernpublic
registers.IntheareaofthecityofNuziinBabylon,informationregarding
descriptionsanddimensionsoflandplotsandtheirsalespricewererecorded
onclaytablets.About200tabletsover6500yearsoldhavebeendiscoveredin
thisarea.DiscoveriesintheEuphratesandTigrisvalleys,datingbacktoaround
4,000BC,suggestthatinthisregionpropertyrightswereprotectedbystabilising
boundarieswithboundarystones.Onclaytablets,however,adescriptionofthe
landwaswritten,includingtheareaofplotsandtheirsize,propertyrightsand
spellstoprotecttheboundariesandowners.34Thesetabletscollectedintemples
constitutedsomeoftheoldestarchivesintheworld.35Theobligationtorecord
deedsofpropertytransferonclaytabletsandtokeepthemwasalsoenshrinedin
Article37oftheCodeofHammurabi.Thepublicbreakingofsuchatabletwith
asaleandpurchaseagreementwastantamounttoinvalidatingthetransaction.36
TheprocedureforbuyingaeldisalsodescribedintheHolyScriptures,inthe
bookofJeremiah37andconrmedinpapyrifoundinElephantine(aJewishcolony
ontheNile).Thetransactionconsistedinwritingthesamecontracttwiceon
onesheet,insuchawaythatonepartwasrolledupandsealed,andtheother
wasrolleduponlywithouttheseal.Ontheonehand,thissolutionwasintended
toallowthecontracttobereadfreelyand,ontheother,topreventinterference
withitscontent.38AnothersolutionwasusedinancientAthens,whereproperty
boundariesweremarkedwithboulderscalledhoroi,onwhichinformation
abouttheownerandloansgrantedwasplaced(pledgepoles).Inscriptionson
theboundarystonesalsoindicatedthattheplotoflandwassubjecttoarightof
repurchaseintheeventofsale.Therstpropertyregisterinthemodernsense,
calledthearchiveofdeedsofpossession(bibliothékeenktéseon),wasinoperation
inthe1stcenturyADinEgypt.Thearchivecollectedevidence,muchlikealand
registerdoes,conrmingrightstoapropertyanditsmortgages,andrecorded
otherimportantactivitiesconcerninglandandslaves,sothatflnoperson
acquiringrightscouldbedeceivedbyhisignorance”
