Codeof1964,exceptfortheregulationsoncommercialpartnerships
andcompanies,whichremainedinforce.Thoseregulationswere
rarelyusedduringthesocialistera,butfollowingthetransforma-
tionsbeginningfromthemid-1980sandintothe1990s,theyturned
outtobeveryuseful.EventuallytheywerereplacedbytheActof15
September2000-CodeofCommercialCompanies,whichharmo-
nizedPolishCompanyLawwithEuropeanregulations.Theformer
CommercialCoderegulationsservedhoweverasabasisandcore
fortheCodeofCommercialCompanies.
3.INDEPENDENCEWITHINTHESYSTEMOFLAW
Therearethreemaintheoriesconcerningtheissueoftheinde-
pendenceofCommercialLawwithintheentiresystemoflaw.
1.Commerciallawisanindependentandseparatebranch
oflaw,havingcommercialturnoverasitsobject.Thistheorywas
supportedbytheadoptionofaseparateCommercialCodeof1934,
beingarathercomprehensiveregulationofcommerciallaw.
2.ThereisnobasisfortheseparationofCommercialLaw
fromtheCivilLawbranch,becausetherearenocommercialmeth-
odsofregulation.CommercialLawadoptingthecivilmethodofreg-
ulationisasub-branchofCivilLaw,regulatinglegalrelationswhich
involvetheparticipationofentrepreneurs.
3.CommercialLawisacomplexbranchoflawregulatingprofes-
sionalturnover,wheretherulesofprivateandpubliclawaremixed
andcomprisemainlycivil,administrativeandfinancialregulations.
Inmoderntimesthesecondtheoryshouldbeadopted.Commer-
cialLawisapartofcivillawandregulateslegalrelationsofaciv-
ilnaturewiththeparticipationofentrepreneurs,andusesthecivil
