totheCommercialCode.Thebasicsourceofcommerciallawisstill
theCivilCodefrom1964,firstofalltheregulationsofBookOne:
GeneralPartandBookThree:Obligations,comprisingfirstofall
thegeneralprovisionsforallobligationsandtheregulationscon-
cerningvariouscommercialcontracts.Ashasbeennoted,commer-
cialcompaniesareregulatedintheCodeofCommercialCompanies.
ItshouldbestressedhoweverthataccordingtoArticle2oftheCode
ofCommercialCompanies,mattersreferringtocommercialcom-
paniesnotregulatedintheCodearegovernedbytheprovisions
oftheCivilCode.TheprovisionsoftheCivilCodeareingener-
aldirectlyappliedtotherelationsofcommercialcompanies.Only
whenrequiredbythecharacter(nature)ofthelegalrelationship
ofthecommercialcompanyaretheprovisionsoftheCivilCodeap-
pliedmutatismutandis.Thisformofregulationisconsideredtobe
areflectionoftheso-calledUnityoftheCivilLawPrinciple.
4.SOURCESOFCOMMERCIALLAW
PolishLaw,belongingtotheCivil(Continental)legalfam-
ily,ismainlyenactedlaw.Thedoctrineofbindingprecedent
isnotpresent,whichmeansthatcourtsarenotboundbytheirpre-
viousjudgmentsorthejudgmentsofhighercourts.Anexception
ismadeforresolutionsbysevenjudgesofSupremeCourtanswering
theimportantquestionsoflawandfiledintheBookofLegalRules,
whicharebinding.Itisoftensaidthatthedivisionbetweenthecivil
lawlegalsystemsandcommonlawlegalsystemstendtoblurtoday,
andthistrendisnoticeablealsoinPoland.ThejudgmentsoftheSu-
premeCourtandAppellateCourtsarepublishedandusuallyfollowed
bythelowercourts,andthusconstituteanimportantsourceoflaw.
Withtheabovereservation,thesourcesofcommerciallawmay
bedividedintonationallaw,internationallaw,contractuallaw,
andcustoms.
