Thesphereofactivityoforgansofinternalaffairshasadifficultstruc-
ture.Itincludesforitselfthecertaingroupsofpublicrelations,which
areconstrained:withprotectingofpersonandstatefromcriminaland
othernotlegalencroachments;withprovidingofpublicpeaceandpublic
safety;withdefenseofobjectsregardlessofpatternsofownership;with
openingandinvestigationofcrimes;withprovidingofobservanceofrules
ofstayinUkraineofforeignersandpersonswithoutcitizenshipandoth-
erslikethat.
Atthesametimeamilitiawillrealizeseparaterightsandfreedoms
ofmanandcitizen,whicharenotrelatedtoprotectiveactivity,butforesee
thegrantoftheproperservices,also.
Theanalysisoftasksandfunctionsthatisexecutedbydifferentsubdi-
visionsofthesystemMIAUkrainetestifiesthatinactivityoforgansofin-
ternalaffairs(tothemilitia)ofquestionofproviding,realization,guard
anddefenseofrights,freedomsandlegalinterestsofmanoccupythe
specialplace.Practicallyallservicesoforgansofinternalaffairsbymeans
ofvariousfacilitiesandmethodsparticipateinthedecisionofthesetasks
directlyontheareasofwork7.
Theanalysisoflegislationandpracticesofworkofvariousservicesal-
lowtodefinesuchbasicdirectionsofactivityoforgans,servicesandsub-
divisionsofMIAofUkraineinrelationtoprovidingofrealization,guard
anddefenseofconstitutionalrights,freedomsandlegalinterestsofciti-
zens:defenseofman,hislife,health,rights,freedomsandlegalinterests
regardlessofage,sex,nationality,racialbelonging,languagesandothers
likethat;non-admissionisintheactivityofillegallimitationsandviola-
tionsofrights,freedomsandlegalinterestsofcitizens.
Amilitianexttootherlawenforcementauthoritiesiscalledtobring
amechanismoveroflegalsafeguardinanaction.Shemustprovideap-
plicationofmeasuresofstatecompulsion,havingforanobjectremoval
ofobstaclesforrealizationamanandcitizenoftherightsandimplemen-
tationofduties,proceedinginthemthebrokenrights,freedomsandlegal
interests,bringinginofwinypersonstolegalresponsibility8.
Thecharacteristicfeatureofactivityoforgansofinternalaffairsisthat
theyinrelationshipswithanindividualpresentallsociety,andatdefense
ofhisinterestsquiteoftenforcedscope,setbyalaw,succeededtolimita-
tionofrightsandfreedomsofthisperson.Butsuchlimitationswimsout
exceptionallyfromconfessionofrespectofrightsandfreedomsofotherper-
sons,inhibitionofrequirementsofmoral,publicpeace,generalprosperity9.
