Bothforeignanddomesticliteraturepointsoutthatlabourlawasabranchoflaw
shouldhavecertaincharacteristicsoruspecific”featureswhichareeitherabsentornot
sostronglyvisibleinotherbranchesoflaw.
Dynamicsandexpansionoflabourlawaretraditionallyconsideredthecharacteris-
ticsrelatingtothelabourlawdevelopmentprocesses.Itispointedoutthatthisbranch
oflawwasdistinguishedandundergoneintensivedevelopmentduringarelativelyshort
period.Sometimes,thisphenomenonispresentedattwolevels:personalandmater-
ial.Asregardsthefirstlevel(personal),labourlawevolves-fromarelativelylimited
groupoffactoryworkers,throughsalesandofficeemployees,farmersandasignificant
numberofpersonsemployedinpublicadministration-toextenditsregulationsto
themajorityofemploymentrelationships.
Expansionoflabourlawasabranchoflawisvisiblenotonlyintherelationswhichhave
notbeenpreviouslyregulatedbutisalsoreflectedbythefactthatitureplaces”regula-
tionsofotherbranchesoflaw,inparticularadministrativelaw(forexample,inthefield
ofemploymentinadministration,managementandsupervisionofwork).Inthisre-
gard,particularlyactiveisadoctrineoflabourlaw,stronglypenetratingtheso-referred
non-employeeemploymentrelationships(niepracowniczestosunkizatrudnienia).This
doesnotmeanthatintheprocessoftransformationoflabourlawitsuarea”,asabranch
oflaw,iscontinuallyincreasing;ithasbeenhighlighted,forexample,thatsocialin-
surancelawwasdistinguishedfromlabourlawtoformanindependentbranchoflaw.
Ontheotherhand,attentionisdrawntothecurrenttendenciestoliberalisationor
evenderegulationoflabourlaw:duetochangesineconomicandsocialconditions,and
inparticularbecauseofdominanceofneo-liberalorevenliberalideologyinfluencing
thelabourlaw-makingprocesses,certainlegalinstrumentsareeitherlimitedinscope
orevenliquidated(mainlythoserelatingtostabilisationofwageentitlement,socialen-
titlementsorsustainabilityofemploymentrelationship).Therefore,labourlawisalso
subjecttoderegulation,andituwithdraws”fromregulationofcertainaspectsofsocial
relations.
Itwouldbeinappropriatetodiscussnowtheaxiologyonwhichlabourlawregulations
shouldbebased.Thevaluesmentionedabovemaybederivedfromdifferentethicalor-
ders.DuringtheperiodofthePolishPeople’sRepublic(PolskaRzeczpospolitaLudowa,
PRL)referencewasmadetotheMarxistaxiology,andnowadaysitiseitherthesocial
ethicsoftheChurchoruniversalhumanrightsandfreedoms.
