1.Theconceptandsubject-matterofinterpretation
oflabourlaws
Itisacceptedinthelegaldoctrinethattheprocessofinterpretationinvolvesallcognitive
activitiesaimedatestablishmentofthepropermeaningoflegalprovisions.Theinter-
pretationactivitiesleadtoestablishmentoftheactualmeaningofparticularnormative
expressions.Fromamongmanyconceptsofinterpretationpresentedintheliterature,
theonewhichmayseemmostusefulintheprocessofdecodingtheprovisionsofla-
bourlawistheinterpretationoftheucurrentlegislature”,accordingtowhichahintfor
interpretationoflawshouldbetheknowledgeofreality,axiologicalpreferencesand
politicalobjectivesofthecurrentlegislature.
Fromatechnicalpointofview,theprocessofinterpretationoflawconsistsprimar-
ilyinthedenotationoftermsusedintheprovision,andfurtherinestablishment
ofthemeaningoftheprovisionitself,thatisdecodingthenormincludedinthepro-
vision.Accordingtotheclaranonsuntinterpretandaprinciple(whatiscleardoesnot
needtobeinterpreted),suchinterpretationwillnotcoverprovisionsthemeaning
ofwhichisclear.However,nothingpreventsinterpretationofprovisionswhichinclude
legaldefinitionsandare,therefore,apparentlyclearbutinfactuseunclearexpressions.
Thelimitsforinterpretationofaprovisionandapplicationofinterpretationprocesses
willbesetinaccordancewiththenumberofunclearelements.
Thedefinitionofthematerialscopeoftheinterpretationoflegalprovisionsmusttake
intoaccountthepluralityanddiversityoflegalactsrecognisedaspartofthesystem
ofsourcesofthebranchoflaw.Thesubject-matterforinterpretationoflabourlawwill
beprimarilytheprovisionsincludedintheLabourCode,otherlaws,includingseparate
lawsgoverningemploymentofspecificcategoriesofemployees,andotherregulations,
thatissourcesoflabourlawintheconstitutionalsense.Itisgenerallyacceptedthatin-
terpretationofsuchlegalactsisaninterpretationinastrictsense.However,according
M.Lekston
