Theprotectivefunctionisfulfilledalsobyprocedurallabourlaws,inparticular,
theproceduralprovisionswhichensurecertainproceduralfacilitiesforanemployee,
forexampleArticle460§2andArticle477oftheCodeofCivilProcedure(Kodeks
postępowaniacywilnego).InthePolishlegislation,regulationsprotectingemployees’
interestsapplyinparticularattheadjudicationstage.Thereisapossibilityofadjudg-
inganalternativeclaim(Article4771oftheCodeofCivilProcedure)oranobligation
todeclare,exoffice,thejudgmentfavourabletoanemployeetobeimmediatelyen-
forceableinapartnotexceedingamonthlyremuneration(Article4772§1oftheCode
ofCivilProcedure).Apossibilityofobligatinganemployertocontinueemployment
ofanemployeeuntilthefinalresolutionofacase(Article4772§2oftheCodeofCivil
Procedure)isalsoanimportantprotectiveinstrument.Similarlyimportantareproce-
duralmechanismsofcontrolbylabourcourtsofparticularstepstakenbyanemployee
incourtproceedings(suchaswithdrawalofaclaim).
3.Organisationalfunctionoflabourlaw
Labourlawfulfilstheorganisationalfunctionwhenitsnormsensureappropriatework
processinabroadsense.Inpersonalterms,theyserveinterestsofanemployersince
thelatterismostinterestedinanefficientandsmoothworkprocess.Inabroadsense,
theorganisationalfunctionoftheindividuallabourlawisexpressedinmanagerial
powers.AccordingtoArticle100§1oftheLabourCode,anemployeeshallcomply
withthesuperior’sinstructions.TheLabourCodeguaranteestoanemployeralsoother
rightsrelatingtotheorganisationofwork,inparticularitreferstoprovisionsrelating
toarrangementofworkingtime(Article135),on-calltime(Article1515),annualleave
planningschedules(Article163§1),andrecallfromleave(Article167).
Asregardsfulfilmentoftheorganisationalfunctionbytheindividuallabourlaw,pro-
visionsgoverningworkdisciplineareparticularlyimportant.Thefirsttomentionare
penaltiesforbreachoforderattheworkplacewhichmaybeimposedonanemployee
fornon-compliancewiththeestablishedorganisationandorderinaworkprocess
(Article108oftheLabourCode).Thelegalprovisionsauthorisinganemployerto
terminateemploymentofanemployeewithoutnoticealsoplaytheorganisational
role.InthisrespectthekeyisArticle52§1(1)oftheLabourCode,underwhich
anemployershallhavetherighttodismissanemployeeforgrossmisconduct.Equal-
lyessentialfortheprotectionoftheemployer’sinterestsarenon-competitionclauses
(Article1011§2).
Apartfromrepressivemechanisms,theorganisationalfunctionisfulfilledalsobyin-
dividuallabourlawsregulatingawardsanddistinctions(Article105).Theyencourage
employeestoproperandcreativeperformanceoftheirduties.Similarlyimportant
ineconomicrelationsareincentiveschemesincludedintheprovisionssettingout
thetermsandconditionsofremuneratingemployees.
