forthesakeofclarity,Ifocusedonthenormativeregulationsinwhichoneofthemen-
tionedfunctionsisvisiblydominant.
2.Protectivefunctionoflabourlaw
Theprotectivefunctionisfulfilledbylabourlawwhenitsnormsprotectoccupational
andsocialinterestsofemployees.Asregardsthepersonalscope,theyoftenapplyalsoto
otherpersonsperformingcommunityserviceorwork,includinginparticularpersons
employedundercivillawcontractsandofficersofmilitaryservice.Provisionsofcollec-
tiveandlabourlawsprotectalsotheinterestsofpensioners,unemployedpersonsand
familiesofworkers.
Tothelargestextent,theprotectivefunctionisfulfilledbytheprovisionsrelatingto
occupationalhealthandsafety(Article207-23715oftheLabourCode).Alsotheprovi-
sionsgoverningthestatusofparticularlyprotectedemployees,suchasparents,young
peopleandpersonswithdisabilities,areaimedatsafeguardingfundamentalinterests
ofthosegroupswithrespecttoprotectionoflifeandhealth.Certainanti-discrimina-
tion(Article183a-183eoftheLabourCode)andanti-mobbing(Article943oftheLabour
Code)provisionsplayanimportantroleinprotectinganemployeeintheworkplace.
Asregardsindividuallabourlaw,theprotectivefunctionisreflectedinmattersrelating
tosustainabilityofemploymentrelationship(Article45oftheLabourCode),working
time(Article131),annualleave(Article154),limitationoffinancialliability(Arti-
cle119)andprotectionofremuneration(Article84oftheLabourCode).
Incollectivelabourlaw,theprotectivefunctionisfulfilledbyprovisionsgoverning
therighttostrike.Intermsofprotectionofemployee’seconomicinterests,ofpar-
ticularimportanceisArticle23(2)oftheActonresolutionofcollectivelabour
disputes,establishingaprinciplethatduringalegalstrikeanemployeeretainsen-
titlementtosocialinsurancebenefitsandentitlementsarisingfromtheemployment
relationship,excepttherighttoremuneration.Inabroadsense,thisfunctionisre-
flectedalsoinregulationsregardingcollectiveagreements.Theyareoftenfocusedon
safeguardingeconomicandsocialinterestsoftheemployedpersons(Article24113§1
oftheLabourCode).
Whenanalysingtheprotectivefunctioninthecollectivelabourlaw,onemustempha-
sizethatintheemploymentrelationsincivilizedstatesthisfunctionisfulfilledalso
indirectly,throughactivitiesofemployees’representatives.Thisrefersinparticularto
tradeunionsandparticipationbodies(forexample,workers’councils).Thisfunction
isillustratedbyArticle4oftheActontradeunions(ustawaozwiązkachzawodowych),
underwhichtradeunionorganisationsshallbeentitledtoprotectbothcollectiveand
individualinterestsofemployees.
