therightofprotectionofwork(employer’sobligationtoprovidesafeandhealthywork-
ingconditions).Therearealsoprinciplesoflabourlawwhichrefertospecificconcepts
orasetofconcepts(aprincipleoflimitedfinancialliabilityoremployee’srighttorest).
Certainprinciplesaredistinguishedalsoinspecificsectionsoflabourlaw,constructs
oflabourlaworitsparts.
Yetanothercriterionofsystematisationoflabourlawprinciplesisthemethodoftheir
expressioninthelegalprovisions.Itshouldbeborneinmindthattheprinciples
innormativetermsarebasedontheprovisionsconstitutingasystemunitsoflegal
acts.Therefore,sometimesaprincipleisexplicitlyexpressedinaprovisionandnamed
bythelegislatureinasimilarwayasinthecaseofprinciplesdefinedinthechapter
oftheLabourCodeonthefundamentalprinciplesoflabourlaw.Thisdoesnotnec-
essarilymeanthataprovisionexpressingtheprincipleisalwayssufficienttocreate
acompletelegalnorm.Sometimes,itisnecessarytorefertootherlegalprovisions
(inparticular,inordertospecifysanctions)orevengobeyondthelabourlawregula-
tions(respectiveapplicationofprovisionsoftheCivilCodeasstipulatedinArticle300
oftheLabourCode).Itisalsopossibletodistinguishprincipleswhichareexpressed
inaspecificprovision(provisions)namedexplicitlynotbythelegislaturebutby
thedoctrineorthecase-law(forexample,theprincipleofprotectionofremuneration
forwork).Someoftheprinciplesoflabourlawareexpressedimpliciteinlegalprovi-
sions.Insuchacase,theyaredistinguishedthroughquasi-logicalreasoning,usually
bygeneralisationofwhatisstatedinasetoflegalprovisions.Thesemaybeincluded
inoneorseverallegalacts,alsosuchthathaveadifferentrankinthehierarchyofthose
acts(forexample,intheLabourCodeandintheConstitutionoftheRepublicofPo-
land),takingintoaccounttheinternationalandEUregulations.Forinstance,such
generalisedconclusionisareferencetotheprincipleofprotectionofsustainability
ofemploymentrelationship,theprincipleoflimitedfinancialliabilityortheprinci-
pleofprotectionofparenthood.Thereisanopinionpresentedintheliteraturethat
theprinciplesreferredtoinArticle300oftheLabourCodeareexclusivelythesecond-
arynorms(alsoreferredtoasmetanorms),reconstructedthroughinductivereasoning
basedontheprimarynormsoflabourlaw(like,forexample,theprincipleofprotection
ofalegitimateinterestofanemployee).Thisallowsdistinguishingthemfromthefun-
damentalprinciplesoflabourlawasdefinedintheLabourCodeandtheconstitutional
principlesexpressedintheprimarynorms.
3.Functionsoflabourlawprinciples
Theprinciplesoflabourlaw,definedbythelegislatureandcreatedbythedoctrineand
case-law,havecertaintaskstofulfiland,therefore,certainfunctionsmaybeassigned
tothem.Inthecaseofnormativeprinciples,theirprimaryfunctionisregulatory.
