separationoflabourlawfromcivillawisconsideredtohavetakenplaceonthedate
ofentryintoforceoftheCivilCode(1January1965),becauseaccordingtoArticleXII
§1oftheprovisionsimplementingtheCivilCode(Kodekscywilny),6itdidnotbreach
thelabourlegislation.Theindependenceoflabourlawasabranchoflawwaseventually
confirmedbytheenactmentoftheLabourCodein19747.Therelationsbetweenlabour
lawandcivillawmaybefoundinanumberofareas.Inparticular,theycanbeseen
inanon-peremptorymethodoflegalregulationcharacteristicofcivillaw,applicable
alsoinlabourlaw,whichassumesautonomyofthepartiestoanemploymentrelation-
shipandnodirectcoercionfromthestate.Anessentialcharacteristicofthementioned
methodisthepredominanceofiusdispositivumregulations(forexample,Article25
§2oftheLabourCode).Thegeneticrelationshipbetweenlabourlawandcivillaw
isobservedalsoinmanyconstructsoflabourlawthatarederivedfromcivillaw(for
example,employmentrelationship,contractofemployment)andweremodelconcepts
formanyothercivillawconcepts(likefinancialliabilityofemployees).Theexistence
ofnormativerelationsbetweenthetwobranchesoflawisalsoconfirmedbyArticle8
oftheLabourCode,whichistheliteraltranspositionofArticle5oftheCivilCodeand
itsconceptofabuseofrightsintolabourlaw.Aboveall,thenormativerelationbetween
labourlawandcivillawstemsfromareferenceincludedinArticle300oftheLabour
CodeunderwhichtheCivilCodebecomesaspecific,statutorysourceoflabourlaw.
AccordingtothementionedprovisionoftheLabourCode,inmattersnotregulated
bytheprovisionsoflabourlaw,provisionsoftheCivilCodeshallapplyrespectivelyto
theemploymentrelationshipifnotcontrarytotheprinciplesoflabourlaw.Therefore,
theprovisionsoftheCivilCodemaybeappliedwhenthereisaloopholeinthelabour
lawinforce.ItmaybearguedthatthroughArticle300oftheLabourCodethelegisla-
turesuggestsaverystronglinkbetweencivillawandlabourlawregulations.
3.Labourlawandsocialinsurancelaw
Intheliterature,socialinsurancelawistreatedasapartofsocialsecuritylaw,which
isaseparatebranchoflawaccordingtotheacceptedsubject-mattercriterion,i.e.legal
relationships.
Therelationbetweensocialinsurancelawandlabourlawresultsmainlyfromthefact
thattheinsurancerelationshipisaconsequenceoftheemploymentrelationship.Es-
tablishmentofanemploymentrelationshipwithinthemeaningoftheprovisions
oflabourlawandundertermsandconditionsspecifiedthereinimplies,exlege,estab-
lishmentofaninsurancerelationshipleadingtocertainregistrationandcost-related
