Therefore,theycanbedirectlyapplicablesincetherearecertainordersandprohibi-
tionsarisingfromthem,addressedtoentitiesthataresubjecttolabourlaw,andthey
grantcertainrightsandpowerstoperformconventionalacts.Becauseofafairlyhigh
levelofgeneralityofanormativeprinciple,itsapplicationrequiresmorespecificnorms
whatissometimesexplicitlystipulatedinaprovisioncontainingtheprinciple(for
example,Article14oftheLabourCodeestablishingaprincipleoftherighttorestindi-
catesalsothatthisrightisguaranteedbytheprovisionsgoverningworkingtime,days
offandannualleave).
Apartfromtheregulatoryfunction,thenormativeprinciplesfulfilalsootherfunctions.
Identificationoftheseprinciplesintermsoftheiressentialnatureandmajorimpor-
tancefortheregulatedmattersleadstoaconclusionthattheyareanuembodiment”
ofcertainideas,rationaleandaxiologicalassumptionsassociatedwiththelegislative
process.Therefore,theserulesshoulddefinethedirectionoffurtherdevelopment
ofthelabourlawandshouldbeguidelinesforlegislativework.Certainly,theprinciples
embeddedintheConstitutionoftheRepublicofPolandareofmajorimportancesince
theyalloweliminationfromthelegalsystemoftheprovisionsfoundbytheConsti-
tutionalTribunal(TrybunałKonstytucyjny,TK)non-compliantwithsuchprinciples.
Normativeprinciplesoflabourlawareatthesametimeinterpretationguidelinesfor
authoritiesinvolvedintheapplicationoflaw.Therefore,theyhavesignificantfunctions
intheprocessofinterpretationoflegalprovisions.Andfinally,theyplayanorganising
andcognitiverolesincetheyexpresswhatismostimportantandmostcharacteristic
oftheadoptedlegalsolutions.
Relativelyhighestattentionhasbeenfocusedintheliteratureonthefunctions
oftheprinciplesoflabourlawinthecontextofArticle300oftheLabourCode.
Itisemphasizedthattheiroriginalfunctionisevaluative.Whenassessingthepossible
applicationoftheCivilCodetoemploymentrelationships,thestartingpointiseval-
uationwhethertheprovisionsinquestionarenotcontrarytotheprinciplesoflabour
law.Ifthereisnosuchcontradiction,aprovisionoftheCivilCodeiscompliantwith
theprinciplesoflabourlawandmay,tothefullextent,servetocreatealegalnormap-
plicabletotheemploymentrelationship.Insuchacase,theprincipleshaveanapproving
function(allowingfunction).Identificationofsuchrelationbetweentheprinciplesofla-
bourlawandtheprovisionsoftheCivilCodeallowsdefinitiveresolutionofamatter
unotgoverned”bytheprovisionsoflabourlaw.If,however,theprovisionsoftheCivil
Codearenotincompliancewiththeprinciplesbutcanbemodified(yetnotcompletely
amended)insuchamannerthattheyarenolongercontrarytothoseprinciples,then
theconditionoftheirancillaryapplicationtotheemploymentrelationshipsspecified
inArticle300oftheLabourCodeismet.Apartfromtheeliminativeandapproving
functions,theprinciplesoflabourlawfulfilalsoamodifying(corrective)function.
AvastmajorityoftheprovisionsoftheCivilCodewhich,infact,refertothesocial
relationsotherthanthosearisingfromperformanceofworkisofnoregulatoryusefor
thelatter.Intermsofemploymentrelationships,theseprovisionsaresimplyirrelevant
