Attheorganisationallevel,theirenicfunctioninthelabourrelationsisfulfilledmainly

byconciliationcommissions.Thesearelegalprotectionbodiesestablishedforamicable

resolutionofindividuallabourdisputes(Articles244-258oftheLabourCode).They

arestillnotlegallycompetenttoresolve,onabindingbasis,casessubmittedtothem.

Inthelabourrelations,theirenicfunctionisfulfilledalsobylabourcourtswithin

tweenthepartiesinadispute,andspecifically,toseektoreachasettlementbetween

suchparties.Intermsoffunctionality,thejudicialconciliationprocedureservesonly

conciliationsincetherearenoongoingcourtproceedingsyet.Itshouldbeborne

inmindthatcourtproceedingsareinitiatedwhenalegalactionisbroughtbeforecourt.

Underthecurrentlaw,thejudicialconciliationschemesfillthegapinthesystem

ofamicableresolutionofindividuallabourdisputes.ProvisionsofArticles184-186

oftheCodeofCivilProcedureareimportantinstrumentsservingtheirenicfunction

ofthelabourlaw.Inmyopinion,thesenormsseemparticularlyusefulinamicableres-

olutionofminormattersrelatingtofinancialliabilityofemployees.Inpractice,this

appliesmainlytomattersrelatingtocashshortageorothercompensationmatters.Sim-

ilarobjectivesarereachedinlabourlawmattersbymediatorsactingunderArticle1831

oftheCodeofCivilProcedure.

5.Redistributivefunctionoflabourlaw

Theredistributivefunctionoflabourlawinvolvestheprovisionsoflabourlawcon-

sistinginestablishmentofabstractprinciplesandgeneralproceduresofredistribution

ofmaterialgoodsandfinancialresourcesinlabourrelationswithindistribution

ofthenationalincome.Intheindividuallabourlaw,provisionsoftheLabourCode

governingtherulesofsettingwages(Articles771-82)areassignedthecentralplace.

Thesamefunctionisfulfilledalsobytheprovisionsofseparatelawsgoverningemploy-

mentofspecificcategoriesofemployeesorbyspeciallegislativeprovisions,forexample

theActof31July1981onremunerationofpersonsinpublicexecutivepositions(usta-

wazdnia31lipca1981owynagrodzeniuosóbzajmującychkierowniczestanowiska

państwowe).13
