Thedoctrinalinterpretation,alsocalledscientificortheoreticalinterpretation,isspe-

cificinthatitisdifficulttodiscussitsbindingforce,alsoinrelationtotheparties

involvedintheapplicationoflaw.Legalinterpretationbylabourlawscholarsmaytake

aformofanabstract,commentaryanalysisrelatingtotheexaminationofaconceptual

scopeofanormativeexpression,andthusaprovisionoraspecific,evaluativeanalysis

usuallyinreferencetothecourt’sinterpretation(commentary).Theadvantageofthis

kindofinterpretationismostcertainlythespecialistandpreciselegallanguage,andits

disadvantageislackofuniformityandmulti-directionalapproach.

3.Processofinterpretationoflabourlaws

Thedoctrineoflabourlawdistinguishestwostagesintheprocessofinterpretation

oflegalprovisions:

1)apreliminaryinterpretationthepurposeofwhichistoestablishwhetheraprovi-

sioninquestionisacurrentprovisionandisincludedinalegalactinforce;

2)anessentialinterpretationwhichinvolvesreconstructionofanormandfurther

determinationofitscontentsusinglinguistic,systemicandfunctionalrules.

Thelinguisticinterpretationconsistsintheestablishmentofameaningofaprovision

usingtherulesoflanguageinwhichtheprovisionisexpressed,inparticularthemean-

ingofwords,contextinwhichtheyareusedorasentencestructure.

Ifdoubtsastothemeaningofalegalnormcannotberesolvedonthebasisoflinguistic

rules,thensuchoptionshouldbeselectedwhichisincompliancewiththeprinciples

ofthelegalsystemtowhichthisnormbelongs.

Functional(teleological)directives,inestablishingthemeaningofalegalprovision,

makereferencetoasocialcontext,totheobjectivepursuedbythelegislatureindraft-

ingthegivenprovision(forexample,theanalysisofprovisionsrelatingtotermination
