PRINCIPLESOFLABOURLAW
1.Theconceptandmeaningoflabourlawprinciples
inthePolishlabourlawdoctrine
TheissueoflegalprincipleshasbeendiscussedformanyyearsbothinthePolishtheory
oflawandinthestudiesonparticularbranchesoflaw,includinglabourlaw.Theirmean-
inghasbeenexplainedinavarietyofways.Accordingtothefollowersofnaturallaw,
legalprinciplesarecertainrulesoutsidethestatutorylawandtranscendentalinnature.
Nowadays,suchapproachisinspiredinparticularbythesocialdoctrineoftheChurch
andbyadoctrineofhumanrightsbasedontheuinherentdignity”ofthehumanbeing
(see,forexample,theUniversalDeclarationofHumanRightsof1948).Thenaturallaw
theoriescompetewiththeconceptsjointlyreferredtoaslegalpositivism.Accordingto
thelatter,thebasisfordistinguishingthelegalprinciplesistheintentofthelegislature
expressedinapositivelegalnorm.
InthePolishtheoryoflaw,thelegalprinciplesbecameamajorconcernattheend
ofthe1960s.Inthisregard,themostimportantisthecontributionofJ.Wróblewski
andthePoznańschooloftheoryoflaw(S.Wronkowska,M.Zieliński,Z.Ziembiński).
AccordingtoJ.Wróblewski,adistinctionmustbemadebetweentheprinciplesofthele-
galsystem(principles-norms)andthepostulatesofthesystem(postulateprinciples).
Theformerarelegalnormsofaparticularsystemorulogical”consequencesofagroup
ofnorms16which,basedoncertaincriteria(suchashierarchicalprecedence),areufun-
damental”.Ontheotherhand,thepostulateprinciplesofthelegalsystemaretherules
whicharenotoftheabove-mentionednature.Therefore,theyareneithernormsofpos-
itivelaw,northeirulogicalconsequences”.AsproposedbytheauthorsofthePoznań
school,adistinctionmustbemadebetweendirectivelegalprinciplesanddescriptive
legalprinciples.Inthefirstcase,attentionshouldbegiventotheprincipleswithin
