2.Typesofinterpretationoflabourlawprovisions

toArticle9oftheLabourCode,thesystemoflegalactsincludingprovisionsoflabour
lawcoversalsocollectiveagreements,othercollectivearrangements,statutesandin-
ternalrules(autonomoussources).Aspecificcharacteristicthatallowsdistinguishing
interpretationofthosesourcesoflawfromtheirdirectinterpretationisthefactthat
themeaningofprovisionsincludedinthoseautonomousactsisestablishedbythepar-
tieswhoparticipateindraftingofthoseacts.
2.Typesofinterpretationoflabourlawprovisions
Inthetheoryoflaw,therearedifferentdivisionsandclassificationswithindifferent
typesoflegalinterpretation.Themostobvious,alsowhenestablishingthemeaning
oftheprovisionsoflabourlaw,istheclassificationbasedontheentitledpartycriterion.
Itallowsdistinguishinginparticular:anauthenticinterpretation,acourtinterpreta-
tionandadoctrinalinterpretation.
Theauthenticinterpretationofthelegalprovisionsistheoneconductedbythelegi-
slativeauthorityitselfaccordingtoaprinciple:cuiusestcondereeiusestinterpretari
(whoeverisauthorizedtoestablishthelawisauthorizedtointerpretit).Withintheau-
thenticinterpretation,referencecanbemadeinparticulartolegaldefinitionsincluded
inthelegalprovisions,suchastheconceptofanemployersetoutinArticle3oftheLa-
bourCode.Ashasalreadybeenindicated,alsointheprocessofdraftingofthesaid
definitions,thelegislatorusesvagueexpressionswhichrequiresecondaryinterpreta-
tion,suchastheconceptofanemployeeinArticle2oftheLabourCodewhich,infact,
referstothebasisoftheemploymentrelationship.Accordingtotheconceptofauthentic
interpretation,theprovisionsofimplementingactsmaybeinterpretedbytheCouncil
ofMinisters(RadaMinistrów)oraministercompetentatlabourlaw.
Certaindoubtsariseastotheapplicationofrulesofauthenticinterpretationtoestablish
themeaningoftheprovisionsoflabourlawincludedinautonomousacts.Intermsofcol-
lectiveagreements,firstly,areferenceshouldbemadetoArticle2411(3)oftheLabour
Code,accordingtowhichtheparties,whiledefiningmutualobligationsintheagree-
ment,maydetermineinparticulartheprocedureforclarificationoftheprovisions
oftheagreementandforsettlementofdisputesbetweentheminrespectthereof.More-
over,accordingtoArticle2416oftheLabourCode,theprovisionsoftheagreementshall
beclarifiedbythepartiesjointly,andtheclarificationsoftheprovisionsoftheagreement,
providedjointlybythepartiesthereto,shallbebindingalsouponthepartieswhohave
concludedanarrangementonapplicationofsuchagreement.Theclarificationsshouldbe
providedtothepartiestothearrangement.Giventhesaidprinciples,attentionshould
bedrawntoaresolutionofthePolishSupremeCourt(SądNajwyższy,SN),14accordingto
