ChapterIII.Functionsoflabourlaw
Theorganisationalfunctionisfulfilledalsobytheprovisionsgoverningtherulesofco-
operationbetweenanemployerandtradeunionsandparticipationbodies.Itrefersto
bothindividual(Article38oftheLabourCode)andcollectiverelations(Article26(2)
oftheActontradeunions.However,tothelargestextentsuchfunctionisfulfilledby
theprovisionsofcollectivelabourlawgoverningtheprinciplesofcollectivebargain-
ing.Theirmainpurposeistopreventdysfunctionoftheworkingenvironment.Inthis
regard,theprincipleofmonopolyoftradeunionstoorganisestrikesisparticularly
important(Article20oftheActonresolutionofcollectivelabourdisputes.Astrike
carriedoutoutsidetradeunionstructuresisillegal.Asimilarroleisplayedbyoth-
erlegallyapproveddirectivesrelatingtostrikes,inparticularaprincipleofeconomic
rationalityandultimaratio.Anexpressionoftheorganisationalfunctionoflabour
lawisalsoanobligationimposedonpersonsonstrikebyArticle21(2)oftheActon
resolutionofcollectivelabourdisputestocooperatewiththeemployertotheextent
necessarytoensureprotectionoftheemployer’spropertyanduninterruptedwork
offacilitiesandequipmentandtorestorenormaloperations.Thisfunctionisdomi-
nantalsointheregulationsgoverningworkers’behaviourduringstrike.Accordingto
Article21(1)oftheActonresolutionofcollectivelabourdisputes,amanagerofanes-
tablishmentcannotberestrictedinexercisinghisrightsanddutiesinrelationto
employeeswhodonotparticipateinthestrikeandtotheextentnecessaryforthepro-
tectionofpropertyanduninterruptedworkoffacilitiesandequipment.
InthePolishlabourlawsystem,particularlyorganisationalarealsocertainprovisions
governingtheconclusionofcollectiveagreements.ThisisillustratedbyArticle2414§2
oftheLabourCodeunderwhichemployees’representativesparticipatingincollective
bargainingshallnotdisclosetheinformationobtainedfromtheemployerandconsti-
tutingbusinesssecret.OfparticularimportanceamongtheseprovisionsisArticle24127
§1oftheLabourCodewhichallowssuspendingtheapplicationofacompanycollec-
tiveagreementbasedonthefinancialsituationoftheemployer.Similarmechanisms
wereintroducedalsoinrelationtothecrisisagreementsconcludedwithtradeunions
underArticles91and231aoftheLabourCode.
4.Irenicfunctionoflabourlaw
Theirenic(conciliatory)functionoflabourlawconsistsinensuringmaintenanceofso-
cialpeaceinemploymentrelationsbymeansoflabourlawnorms.Thepurposeofthese
normsistopreventsocialconflictsintheworkingenvironmentandtoamicablyre-
solvepossibleconflictsthroughformalprocedures.
Thisfunctionisfulfilledinparticularbycollectivelabourlawswhentheyintroduce
differentformsofamandatorydialoguebetweensocialpartners.Thisisthecase
incollectivelabourdisputes.Anemployerlodgingadisputemustimmediatelystart
