1.Generalnotes
ThedeterminingofthepositionoflabourlawinthePolishlegalsystemconsistsinde-
finingitsplacewithinthelegalsystemanditsrelationtootherbranchesoflaw.
Giventhegenerallyaccepteddivisionofthelegalsystemintotwomainbranches
oftheprivatelawandthepubliclaw,theopinionspresentedintheliteratureshouldbe
accepted,accordingtowhichlabourlawincludeselementsofbothofthoselegalsys-
tems.Wherethereisanareaofnon-prohibitedactivities,certainelementsoftheprivate
lawcanbefound;ontheotherhand,thenormsgoverningstateinterferenceintheem-
ploymentrelationshipsinaformofordersandprohibitionsrelatingtolegalprotection
ofworkarecharacteristicofthepubliclaw.
Whenalegalsystemistreatedasasetofbranchesdistinguishedonthebasisofvarious
criteriaandthelabourlawisregardedasaseparatebranch,todeterminetheposition
ofthelatterinthesystemitisnecessarytoidentifyrelationsandinterlinksbetween
thelabourlawandotherbranchesoflaw.Thefactisthatlabourlawisinterdisciplinary
andcrosseswithotherbranchesclassifiedeitherwithintheprivateorpubliclaw.Tak-
ingintoaccountthesubject-matteroflabourlawandthefunctionalrelationsbetween
thesubject-matteroflabourlawandothersocialrelations,itisessentialtodetermineits
relationto:civillaw,socialinsurancelaw,copyrightlaw,constitutionallaw,administra-
tivelaw,criminallawandinternationallaw.
2.Labourlawandcivillaw
Althoughitisagenerallyacceptedargumentthatlabourlawisseparatefromciv-
illaw,itseemsreasonabletoemphasizethegeneticrelationofthesetwobranches
oflaw.Itisbecausethelabourlawdevelopedfromaucivilstem”anditrefersmainlyto
