mentisanobjectiveofthelegislature).Thefunctionalinterpretationisbasedon
theassumptionofrationalityoflegislature,accordingtowhichananalysisofapro-
visionshouldberational,namelythemeaningoftheprovisionshouldbeestablished
byreferencetosocial,politicalandeconomicprinciples.Duetothefactthatalarge
numberoflabourlawregulationswereenactedafewdecadesagoandtheyhavenot
yetbeenamended,itseemsnecessarytoapplyalsoahistoricinterpretationwhichputs
anemphasisontheintentofthelegislaturewhentheprovisionsandtheentirelegal
actweredrafted.
Importantly,thereisaspecificsequenceofapplicationofdirectivesinthesecond
phaseoftheessentialinterpretation,namelythefirstoneshouldbethelinguisticin-
terpretation,followedbythesystemicandfunctionalinterpretation.Moreover,these
lattertwointerpretationsareuselesswhenthemeaningofaprovisionhasbeenestab-
lishedusinglinguisticrules.Itisalsoimportanttoemphasizeacloserelationbetween
thesystemicandfunctionalinterpretationimplyingthepossibilityoftheirsimulta-
neousapplication.
Dependingontheeffectsofapplicationofparticular(linguistic,systemicorfunction-
al)directives,theinterpretationmaybebrokenintothreedistinctclasses:
1)declaratoryinterpretation(interpretatiodeclarativa)inwhichresultsoftheanaly-
sisofaprovisionareconformable;
2)restrictiveinterpretation(interpretatiorestrictiva)whenthemeaningofaprovision
isnarrowerinscopethanitsmeaningbasedonthelinguisticinterpretation;
3)extensiveinterpretation(interpretatioextensiva)whenasystemicorfunctional
interpretationproducesthemeaningofaprovisionwhichisbroaderinscope
thanthemeaningresultingfromthelinguisticinterpretation.
4.Loopholesinlabourlaw
Inthelabourlaw,likeinotherbranchesoflaw,onemayidentifycaseswhenpartiesor
authoritiesinvolvedintheapplicationoflawcannotfindanecessarysolutionintheap-
plicablenormativeprovisions,whichgiverisetoloopholesinlaw.
Characteristicofthelabourlawisatechnicalloophole(lukatechniczna),i.e.theab-
senceofaregulationforaparticularsituationintheprovisionsofthisbranchoflaw,
whichdoesnotmeanthatsuchregulationisabsentinotherbranchesoflaw.According
toArticle300oftheLabourCode,inmattersnotregulatedbytheprovisionsoflabour
law,theprovisionsoftheCivilCodeshallapply,respectively,totheemploymentrela-
tionshipifnotcontrarytotheprinciplesoflabourlaw.Thisprovisionnotonlysignals
existenceoftechnicalloopholesinthelabourlawbut,mostimportantly,introduces
amechanismfortheirremoval.
