6.Labourlawandadministrativelaw
Todescribearelationbetweenlabourlawandadministrativelaw,itisnecessary-for
thesakeofclarityofconcepts-toadoptabroadapproachtoadministrativelawas
asetofprovisionsandnormsgoverningtheorganisationandoperationsofpublicad-
ministrationaswellasbehaviourofentitiesinmattersnotregulatedbytheprovisions
ofotherbranchesoflaw,assumingthatinadministrativelaw,aspartofpubliclaw,pub-
licinterestisofkeyimportance.Therefore,thisbranchisbasicallyfarfromlabourlaw
sincetheprovisionsofthelattergenerallyputanemphasisontheprotectionofanem-
ployeeandprotectionofanindividualinterest.However,suchargumentmustbe
accompaniedbyanobservationthattherearemanycloserelationsbetweenthenorms
ofadministrativelawandthoseoflabourlaw,suchasprovisionsrelatingtoservice
relationships,protectionofworkorunemployment.Asregardsservicerelationships
(stosunkisłużbowe),aparticularmentionmustbemadeofthoserelationshipswhichare
basedonnomination(mianowanie)sincetheactofnominationitselfisthebestexam-
pleofinterlinksbetweentheanalysedbranchesoflaw.Thereisanargumentpresented
intheliteratureaccordingtowhichtherearenogroundsdelegelataforuniformand
generaltreatmentoftheinstrumentofappointmentasanadministrativeactoralabour
lawactsinceitisnotauniformlegalconstruct,asconfirmedbytheanalysisofsepa-
ratelawsgoverningemploymentofspecificcategoriesofemployees(calledpragmatyki).
Asregardstherighttoprotectionofwork,attentionshouldbedrawninparticularto
theformsofstatesupervisionofcompliancewithlabourlaws,whichoriginateinad-
ministrativelaw.
7.Labourlawandcriminallaw
Relationsbetweenlabourlawandpubliclawmayalsobeidentifiedbyreferenceto
criminallaw,andinparticulartotheprovisionsincludingcriminal-lawsanctions.
AsregardstheLabourCoderegulations,theseareprovisionsgoverningliabilityofem-
ployeesforbreachoforderattheworkplace,andasregardsnon-Coderegulations,also
provisionsondisciplinaryliabilitysinceallofthemusethepenaltyconcept.
Therelationbetweenlabourlawandcriminallawisreflectedalsoinpenalisation
whichappliesbothinindividualandincollectivelabourlaw.Regardlessoftheoffences
definedintheCriminalCode8(ChapterXXVIII:Offencesagainstemployedpersons),
