obligationsofanemployer.Suchacloselinkbetweenthoserelationshipswasthebasis
foranassumptionthatsocialinsurancelawshouldbequalifiedaspartofthelabourlaw
system.However,worthnotingareargumentspresentedinthedoctrinewhichempha-
sizethedifferencesjustifyingthedistinctionbetweenthepurposeoftheemployment
relationshipsandinsurancerelationships,differentpositionsofpartiestothoserela-
tionships,adifferentpersonalscopeaswellasdifferentnatureofdisputesandposition
inthedisputeswithregardtolabourlawandcivillaw.
4.Labourlawandcopyrightlaw
Thecopyrightlawgovernscertainaspectsrelatingtoworkasaresultofindividualcre-
ativeactivity,aswellasrightsofanauthorandtheprinciplesforgrantingalicenceto
usethework.
Themainpartofcopyrightlawincludesprovisionsgoverningmoralandeconom-
icrights.Therelationbetweenlabourlawandcopyrightlawreferstothelatter(i.e.
economicrights),connectedtotheemployee’swork,includingscientificwork.Norms
ofcopyrightlawcreateaconstructofacquisitionbytheemployerofeconomicrights
toaworkwithinthelimitsdefinedbythepurposeofacontractofemploymentand
incompliancewithamutualintentoftheparties.Importantly,forthementionedcon-
structtobeeffectiveitisnecessarythattheworkiscreatedasaresultofperformance
oftheemployee’sdutiesofacreativenature,arisingfromtheemploymentrelationship.
5.Labourlawandconstitutionallaw
Constitutionallaw,governingthepoliticalandsocio-economicsystemofastate,
doesnotregulateaspecificareaofsocialrelationsbutlaysdownthefoundationsfor
differentbranchesoflaw,andthisiswhereitslinkswithlabourlawmaybeseen.
Itisgenerallyacceptedthatthisrelationshouldbeviewedmainlywithregardtoconsti-
tutionalprinciplesunderlyingboththecollectiveandindividuallabourlaw,developing
thefundamentalprinciplesoflabourlawexpressedintheLabourCode.Inthissense,
theConstitutionoftheRepublicofPolandprovidesfor:statesupervisionofcompliance
withlabourlaws(Article24),righttoequaltreatment(Article33),freedomoflabour
(Article65(1)and(5)),righttotheminimumremuneration(Article65(4)),rightto
healthyandsafeworkingconditions(Article66(1)),andrighttorest(Article66(2)).
Asregardscollectivelabourlaw,theseprinciplesinclude:rightofcoalition(Arti-
cle59(1)),righttobargaincollectively,righttoresolvelabourdisputes(Article59(2)),
andprincipleofsocialdialogue(Article20).
TherearealsosuchregulationsinthePolishConstitutionwhicharenotreflected
intheprinciplesoflabourlawbutareexplicitlyregulatedtherein,suchasthechapter
M.Lekston
