5.Redistributivefunctionoflabourlaw

Theprovisionsgoverningguaranteepayments(wypłatygwarancyjne)alsoplayaredis-
tributiverole.Ireferprimarilytotheprovisionsoftheindividuallabourlawwhich
establishtherightofanemployeetoremunerationinasituationwherethelatterdid
notperformwork(Articles49,81,210§3)orobtainedaleaveofabsence(Articles37,
188,23713§2oftheLabourCode).Thisfunctionisfulfilledalsobytheprovisionson
severancepayments(Article921oftheLabourCode)orfinancialbenefits(e.g.holiday
benefits).
Intheeconomicrelationsofthecivilisedstates,abasicinstrumentoftheredistribu-
tivefunctionoflabourlaw,incollectiveterms,arecollectiveagreementsandother
socialarrangements.Inparticular,theredistributivefunctionoflabourlawisfulfilled
bythecollectivelabouragreements(układyzbiorowepracy).Inthiscontext,attention
shouldbedrawntotheirnormativeaspect.InthePolishbusinessrelations,theyconcern
mainlywageissues.Sometimes,thepartiessetouttheentiresystemsofremuneration,
startingfromwagescales,throughindexationclauses,towageuregulators”.Asocial
partofcollectiveworkagreementsalsoplaysaredistributiveroleinrelationtodistri-
butionofgoodsandresources.Veryoften,itregulatesindetailthesourcesoffinancing
ofacompanysocialfund(zakładowyfunduszsocjalny)andtherulesofmanagement
ofthefund.Thesocialpartofthecollectiveagreementsmayalsoestablishvariouseco-
nomicprivilegesforemployeesandotherbeneficiariesoftheagreements.
Theredistributivefunctionisclearlyvisiblealsointheprovisionsofthecollectivela-
bourlawwhichdirectlygovernwageissues.Forexample,areferencecanbemadeto
Article24126§2oftheLabourCode,accordingtowhichacompanycollectiveagree-
mentmaynotsetouttherulesofremunerationofpersonsmanagingthebusinesson
behalfofanemployer.Similarredistributivefunctions,intermsofdistributionofgoods
ineconomicrelations,arefulfilledbysocialtransferagreements(socjalneporozumienia
transferowe)concludedontheoccasionofownershiptransformationsinundertakings.
Inpractice,apartfromthesystemofguaranteesofemployment,theyalsoprovidefor
certainsocialandeconomicbenefitsforthepersonnelorindividualemployeesfrom
theinvestor(suchasnon-repayableorlow-interestloansforthepurchaseofshares
intheprivatisedcompany).Othercollectivearrangementsconcludedeitherattheend
ofalabourdisputeorwithinaninstitutionalisedsocialdialogue,veryoftenregulate,
inageneralandabstractmanner,theprinciplesofredistributionofgoodsinbusiness
relations.
