Therefore,theliteraturedevelopedaspecificustandard”methodofdefiningandthere-
lateddefinitionsoflabourlawwhichmaybecalledustandard”definitions4.
Bothtypesofthedefinitionshavecertainfunctionalelementscalledontological,sys-
temicandsubject-matter:
1)thefirstoneassumesexistenceoflabourlaw(asaspecificsetoflegalnorms),
2)thesecondtreatssuchsetofnormsasaseparate,independentbranchofagiven
legalsystem,and
3)thethirdmakesreferencetothesetoflegalnorms(usubject-matteroflabourlaw”).
Sincethetimeofcodificationofthelabourlaw,ourlegalsystemhasusedthelegal
definitionofulabourlaw”.Itshouldbeunderstoodas:u(…)provisionsoftheLabour
Codeandprovisionsofotherlaws(ustawy)andimplementingacts(aktywykonawcze)
regardingtherightsandobligationsofworkersandemployers,aswellasprovisions
ofcollectiveagreements(układyzbiorowe)andothercollectivearrangements(poro-
zumieniazbiorowe)basedonlaws,internalrules(regulaminy)andstatutes(statuty)
concerningtherightsandobligationsofpartiestoanemploymentrelationship”.
Itshouldbenotedthatconsecutiveparagraphsoftheabovementionedarticleestablish
aspecifichierarchyofsourcesoflabourlaw.
Definitionsoflabourlawassumeforanelementthesubject-matterofagivenbranch
oflaw.Itisrightlypointedoutthatnosuchsocialrelationsexistwhichwouldgener-
allybeuuniforminnature”andgrouping,systematisationandclassificationofsuch
relationsarelogicalmeasuresbasedonastatedconvention.Throughuarbitrarycon-
vention”lawyershavedeterminedalsothesubject-matteroflabourlawandagreedthat
thisbranchoflawgovernsallsocialrelationsrelatingtosubordinatedworkofpeople.
Quitecommonly,thoserelationswerecalledlabourlawrelations.Althoughtheprevi-
ouslymentioneddefinitionsoflabourlawgiveanimpressionofuniformityofopinions
onthesematters,thesubject-matteroflabourlawstillremainsverycontroversialand
theviewsonthelabourlawstillvaryintermsoftimeandspace.Asnotedearlier,such
usocialemploymentrelations”mustbedefinedformally,throughuarbitraryconven-
tion”.Inthisregard,areferencecanbemadetogeneralremarksoflegalacademics
accordingtowhichuintheabsenceofappropriatelygeneralcriteria”thesubject-matter
oflabourlawshouldbedistinguishedunotthroughaclassicdefinitionbygenusanddif-
ferentiaspecificabutthroughspecificationofitscomponentparts”.Eachauthorofsuch
definition,havingspecifiedtheuemploymentrelationships”,tofurtherdetermine
thesubject-matteroflabourlawmustlistandindicatethosegroupsofsocialrelations
whichheconsidersupracticallyrelatedtowork”.
Arelativelybroaderconsensuswasachievedinrelationtotheconceptofuemployment
