andhaveahomogeneousstructure.Andthescopeofuemploymentrelationships”
shouldbedeterminedbythealreadydefinedcriteriawhichdistinguishthemfromoth-
erobligationrelationships,suchas:continuityofwork,remuneration,performance,
subordinationofanemployeeandriskoftheemployerassociatedwiththeworkpro-
cess.However,itisstillpointedoutthatsuchcriteriadonotensureprecisedelimitation
ofthoserelationships.Inthiscontext,thelegalnatureofspecificrelationswasoften
determinedbycase-lawwhichdeveloped,underthesamelegalprovisions(Articles2,3,
22oftheLabourCode),thevariablescopeofthatconcept.
Evenmorediscussionsandscholarlydisputes,causingfar-reachingconsequences
inthepracticeoflawenforcementauthorities,arisefromremovalofthoseareasofsocial
relationswhichshouldbeconsideredudirectly”anduintrinsically”linkedtoemployment
relationships.Thisappliesbothtospecificationofthegroups(types)ofsocialrela-
tionswhichshouldbeapartofthesubject-matteroflabourlawandtodetermination
ofthescopeofsocialrelationswhichshouldbeincludedineachofthosegroups.
Thoserelationswerepresentedinourliteratureonthesubjectindifferentways:
1)byplacingthemonthetimeaxisandcomparingtheirdurationtotheduration
ofanemploymentrelationship,
2)bytakingintoaccountboththesubject-matterandthemethodoflegalregulation
oftherelationshipsincludedinthelabourlaw(seesection2ofthischapter).
Historicallyolderisthefirstone,wherethefollowingrelationshipsaredistinguished
besidestheemploymentrelationship:
1)relationshipsprecedingtheemploymentrelationship,
2)relationshipsestablishedalongwiththeemploymentrelationshipandconcurrent
withtheemploymentrelationshiporevenexceedingitsterm,
3)relationshipsresultingfromthealreadyterminatedemploymentrelationship.
Therelationshipsprecedingtheemploymentrelationshipincludemainly:jobmatch-
ing,jobcounselling,vocationaltraining(naukazawodu),apprenticeship(przyuczenie
dookreślonejpracy),legalrelationsconnectedwiththeconclusionofemploymentrela-
tionships(suchascompetitions,preliminarycontracts);itisquestionablewhethersome
newtypesofsocialrelationships,suchasrelationshipsrelatedtointernshiporvolun-
teering,shouldbeincludedinthisgroup.
Thesecondgroupincludesrelationsconnectedwiththecollectiverights(ofgroups
ofworkers,e.g.benefitsfromthecompanysocialbenefitsfundor,asarguedbysome
scholars,occupationalpensionschemes),employeeco-managementrelationships,
relationshipsinvolvingestablishmentofandparticipationinprofessionalorganisa-
tions(employers’organisations,workers’organisations,mainlytradeunions).This
groupincludesalsorelationswithinindividualandcollectivelabourdisputes.Some
legalscholarsincludeinthiscategoryalsolegalrelationsconcerningsupervisionover
