resolutionofcollectivelabourdisputes,negotiationsbetweenpartiestoadisputeshall
beobligatory.Fromanormativepointofview,thepartiescannotavoidthenegotiations.
Theirenicfunctioninthelabourlawsystemisfulfilledalsobymediationwhichcon-
sistsinparticipationofathirdparty,amediatorbetweentheparties,inordertoreach
amutuallyacceptablecompromise.InviewoftheprovisionsofArticle10oftheActon
resolutionofcollectivelabourdisputes,thereisnodoubtthatthemediationprocedure
isobligatory.Inpractice,itmeansthatapartycarryingoutadisputeonbehalfofem-
ployeesmaynotskipthisstage.Suchregulationisundoubtedlyaninstrumentserving
anamicableresolutionofacollectivelabourdispute.
Theirenicfunctionofthelabourlawisalsofulfilledbytheprovisionsgoverning
collectiveredundanciesprocedure.AccordingtoArticle2oftheActoncollectivere-
dundancies(ustawaozwolnieniachgrupowych),12anemployerplanningmasslayoffs
shouldinformtradeunionsthereofinordertocarryoutconsultations.Themainpur-
poseistoreducethenumberoftheredundanciesandmitigatetherelatedtensions
intheworkplace.
Attheinstitutionallevel,theirenicfunctioninthecollectivelabourrelationsisfulfilled
byentitiesappointedtosupportthesocialdialogue.ThefirsttomentionisaTripartite
CommitteeforSocialandEconomicDialogue(TrójstronnaKomisjadoSprawDialogu
Społeczno-Gospodarczego).InthisCommittee,socialpartnersnegotiateonfundamental
economicandsocialfactorsoflabourrelations.Attheregionallevel,theirenicfunction
isfulfilledbytheregionalcommissionsofsocialdialogue(wojewódzkiekomisjedialogu
społecznego).UnderArticle17oftheActontheTripartiteCommitteeforSocialand
EconomicAffairs(ustawaoTrójstronnejKomisjidoSprawSpołeczno-Gospodarczych),
theircompetencesincludegivingopinionsonanymattersofsocialsignificance,falling
withintheresponsibilitiesoftradeunionsandemployers’organisations.Someiren-
icelementsarevisiblealsoininformationandconsultationprocedurescarriedoutby
workers’councils.
Inspiteofappearances,theirenicfunctionoflabourlawisnotlimitedtothecollec-
tivelabourlaw.Inmyopinion,itisfulfilledalsobyindividualandprocedurallabour
laws.Inparticular,itreferstoArticle243oftheLabourCodewhichprovidesthatboth
anemployerandanemployeeshouldseekanamicableresolutionofadisputearising
fromanemploymentrelationship.Italsoindicatesasociallydesireddirectionofactivi-
tiesofthepartiesinvolvedinalabourdispute.ThefactthatArticle243oftheLabour
Codewasincludedamonggeneralprovisionsmeansthatthedirectiveexpressedinit
appliestoallstagesoftheprocedure,frommediationbeforeamediationcommis-
siontotheconclusionofproceedingsbeforeacourtofthesecondinstance.Itmustbe
